Mr. Blakemore stated the developer must have side barred this. He was at the last meeting this
was discussed and it was stated after the meeting by a commissioner that there would have to be
a good reason to rezone this land from commercial to residential.

Chairperson Nixt explained the applicant has worked with the City to get a land use request
reviewed and up for approval and consideration. He does not want it to be made to appear that
the City has modified their policies or procedures to accommodate this applicant, which is not
the case to his knowledge.

Mr. Blakemore stated the Commission informed the applicant at the last meeting that the
residents of the area do not like what has been proposed and that it should be reworked. The
applicant has reworked the plan into three different proposals, but there was no inclusion of any
of the residents in the process.

Chairperson Nixt explained the process was followed; if the residents have more interest there
are established office hours to meet with staff.

Commissioner Brauer stated the minutes of the meeting when this was last discussed reflect his
statement that for him to say yes to this, there would need to be a good reason for it, and it could
not just be for monetary gain. That statement was his personal position, not the position of the
rest of the Commission. In addition, he thinks Chairperson Nixt has stated the issue fairly well,
in that this is a challenged site. The question for the Commission is whether the site is
challenged enough that the Commission is willing to change the zoning because they cannot see
any other way to develop the site. Good people will differ on that issue, and some of his
colleagues may feel there is nothing else that can be done with this site, and that this is the best
use of the site.

Mr. Roy Hillyard, 13711 and 13718 Dolomite Street NW, stated his property is immediately
adjacent to this property. He understands this lot is large enough to sustain three residential units
under single family zoning, and he would be okay with that.

Mr. Leroy Kessler, 6774 137th AvenueNW, stated there have been quite a few problems in their
neighborhood because of the development put in to the northwest of them. Just.the other day he
had someone come up on his sidewalk in broad daylight, slice his garden hose and run. The day
before yesterday someone came lip and rang his doorbell, but by the time he got there they were
gone. This is a problem that is happening that they never had before. He is in favor of a
business going here, and does not agree that a business will not work there.

Ms. Defore, 6166 RivlynStreet NW, stated she has lived in this neighborhood for 18 years.
They have had all kinds of trouble with the townhomes, and she does not want any more
multifamily or townhomes. She took her grandchild to the park in her stroller and was told by
five kids that they need money or they will not be able to play in the park today. They could put
in a dentist office or small business here, and all the buildings leaving the north side of Highway
10 will be looking for a place to go.

Planning Commission/September 7, 2006
