Mr. Murphy stated a typical mortgage payment for these units will be between $2,000 and
$2,500 per month. The units being proposed will not fit in with any low income profiles. If
anyone wants to start a fund to help them finance an office building on this site, they would
consider it.

Ms. Defore stated she has gone 18 years with no bikes stolen, and now they have had them
stolen. They would be happy to work with the developer for some other type of arrangement.

Mr. Wolens stated as a former council member in another city, the thing he usually tries to do is
listen to the people in the community. The Commission has more guts than he does to change
this zoning, which has gone before the Metropolitan CounciL

Chairperson Nixt stated this Commission is a recommending body. He will take under
advisement the comments provided by the residents, and take into account the comments of staff.
The Commission will make a recommendation to the City Council who will make the final
decision. The residents should be prepared to make their recommendation of pros and cons when
this goes before the CounciL This will go before the City Council the fourth Tuesday of this
month. He encouraged the residents to reach their council members and staff, and to use the
available resources to their advantage in order to communicate their positions.

Motion by Chairperson Nixt, seconded by Commissioner Brauer, to close the public hearing.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Cleveland Hunt,. Levine,
and Trites Rolle. Voting No: None. Absent: Commissioner Van Scoy.

The public hearing was closed at 7:57 p.m.

Commission Business

Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:57
p.m.

Motion by Commissioner Levine, seconded by Commissioner Brauer, to recommend that City
Council deny the request for a Comprehensive Plan Amendment due to the need for a very
compelling reason to amend the land use.

Further discussion: Commissioner Brauer commented this case reminds him of a similar one on
Highway #47 across from the Holiday Station where there is a property that is now zoned B-2
that is essentially in a residential development. The person who owns the property came to the
Planning Commission at the time with the idea of putting townhouses on that piece of property.
The recommendation of the Planning Commission was that the property should remain zoned
with the office use, and that the property owner should try to determine if they could get an
office tenant in there. He believes this is the same as that case, and he sees no reason to change
this zoning.

Planning Commission/September 7, 2006
