Commissioner Brauer stated that if the property owner have not agreed to sell the property than <br /> he did not see how they could rezone the property, yet the developer still wants to rezone the <br /> property around them and landlock them with medium density surrounding their property. <br /> Chairperson Nixt requested that they table the discussion on the merits until a future time. <br /> Councilmember Zimmerman stated that one problem in Ramsey is that the fee title owner is not <br /> required to make the application to rezone a piece of property. He felt that property owners <br /> should have the right to rezone their property and they should be the one instigating the rezoning, <br /> not a developer. <br /> Councilmember Anderson replied that there are many changes that the City makes without a <br /> request by the property owner. <br /> Chairperson Nixt stated that they needed to schedule a joint meeting between the Planning <br /> Commission and City Council to discuss the land use issues, but want to focus on the public <br /> hearing at this time. <br /> Julie Horn, 6031 145th Lane NW, Ramsey, stated that her concern had to do with proposed land <br /> use amendment 910. The land is being proposed to be used for low and medium density, but the <br /> land surrounding the property is all single family homes. On July 14, 1999 a request was made to <br /> rezone the property for a potential purchase by Pulte Homes. At that time a petition was <br /> circulated and over 150 signatures were received opposing the rezoning. The residents in that <br /> area purchased their homes based on the land being single family homes. The neighborhood is <br /> extremely against the change. She stated that she did see an area identified as a"buffer area", but <br /> if a developer comes forward with a Planned Unit Development the entire site could be developed <br /> medium density. Ms. Horn also expressed concern with the large number of medium density <br /> plans being presented because of the impact the higher density will have on streets and schools. <br /> Councilmember Kurak is a member of the Council and residents are very worried about the <br /> conflict of interest with her voting on the land use change <br /> Chairperson Nixt stated that they were there to hear comments on why or why not a land use <br /> should be changed. The issue regarding a possible conflict of interest will addressed at a different <br /> time. <br /> Ms. Horn replied that the residents have hired legal counsel regarding the issue. She stated that <br /> the property is not close to any amenities, not close to highways and does not fit with the <br /> neighborhood. She stated that she would like to hear support as to why the land use request has <br /> advanced to this point. <br /> Sandy Bertzyk, 6601 146th Avenue NW, Ramsey, stated that her home borders the Kurak <br /> property and she also received numerous signatures from the neighborhood that were not <br /> opposed to the proposed development once they were informed as to what would happen with the <br /> land.
