determined the value of the Vasseur parcel•to be $61,605. The Vasseur parcel does include the <br />necessary right of way and an extensive wetland area for a total size of 41.07 acres. This then is <br />the amount, which the City will need to offer the landowner for title to the parcel. The <br />landowner has the option of accepting the appraisal amount or going forward with the <br />condemnation process including commissioner hearings as well as a District Court trial. The <br />final amount paid to the parcel owner could, therefore, be more than the $61,605 if so determined <br />by the commissioners and/or District Court Judge. In order for the City to acquire title to the <br />parcel now the City must deposit the $61,605 with the District Court or pay it to the owner at the <br />owner's discretion. This deposit cannot be made until the Council approves the appraisal <br />amount. <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to adopt <br />Resolution #00 -03 -166 approving the appraisal amount of $61,605.00 for acquisition of the <br />41.07 -acre Vasseur parcel. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Kurak. Voting No: None. <br />Case #8: Adopt Right -of -Way Ordinance <br />City Administrator Norman stated that on January 11, 2000, an ordinance regulating the use of <br />the right -of -way within the City was introduced. This ordinance was patterned after a model <br />ordinance prepared by the League of Minnesota Cities. At that meeting, representatives for <br />Connexus Energy requested an opportunity to meet with City staff to review a number of <br />concerns with the ordinance. Connexus Energy suggested a number of changes to the Ordinance. <br />These changes were reviewed by the City Engineer, the City Attorney and ultimately the Public <br />Works Committee. The amended ordinance was then reintroduced on March 21, 2000. When <br />the ordinance was considered for adoption at the April 11, 2000 Council meeting, a <br />representative of Reliant Energy appeared requesting adoption be delayed for two weeks to allow <br />for their in -house expert to review the proposed ordinance. The Council agreed to table the issue <br />until April 25 "' and again until May 9', so that the ordinance could be reviewed by other <br />potentially affected utility companies. Copies of the ordinance have been sent to Media One, US <br />West, and NSP. It has now been over nine months since this ordinance was last discussed. Staff <br />believes that the City has allowed sufficient review and comment from various utilities and the <br />ordinance should be considered for adoption. Mr. Norman noted that staff received a call from <br />Connexus Energy expressing concern over the ordinance, but did not have any proposed changes. <br />Staff advised Connexus Energy that if they had any proposed changes that the Council would <br />consider them in the future. . <br />Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to adopt Ordinance # 01 -10 <br />establishing regulations governing activity within the right -of -ways within the City of Ramsey. <br />A roll call vote was performed by the Recording Secretary: <br />City Council /March 27, 2001 <br />Page 18 of 22 <br />—36— <br />
