Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br />RESOLUTION #93 -03 -033 <br />A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED <br />CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, INC. <br />BASED ON RESOLUTION #93 -02 -023 ADOPTING FINDINGS OF FACT #0329 <br />AND DECLARING TERMS OF CONDITIONAL USE PERMIT <br />WHEREAS, the consideration of approval for the request for a conditional use permit <br />amendment is based on the City's determination that the amendment is consistent with the intent <br />and purposes of Chapter 9.03.04 (Conditional Use Permits) of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On March 9, 1993, an amended conditional use permit ( "CUP ") was approved for issuance by the <br />City of Ramsey ( "City ") to Danny's Aluminum Processing, Inc. ( "Permit Holder ") to expand the <br />operations of the aluminum processing facility to include the disassembly of engines and <br />transmissions on the property general known as 14050 Basalt Street N.W. and legally described as <br />follows: <br />Lot 1, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota, <br />hereinafter "site ". <br />This permit is issued pursuant to Section 170.013D of the Ramsey City Code. The conditions of <br />this permit are as follows: <br />1. Term. This permit shall remain in effect so long as the conditions imposed herein are <br />complied with. <br />2. Noise. Noises emanating from the site and operations shall be in compliance with and <br />regulated by the *State of Minnesota Pollution Control Standards, Minnesota Rules <br />7010.0010 to 7010.0080, as amended except as modified herein by City performance <br />requirements. <br />3. Dust/Ash /Particulates. The emission of dust, ash or other particulate matter shall be in <br />compliance with and regulated by the State of Minnesota Pollution Control Standards, <br />Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Part 50, as <br />amended except as modified herein by City performance requirements. <br />4. Odor. The emission of odor from the operation shall be in compliance with and regulated <br />by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as <br />amended except as modified herein by City performance requirements. <br />5. Smoke. The emission <br />regulated by the State <br />7005.0480 subp. l.B., <br />requirements. <br />of smoke from the operation shall be in compliance with and , <br />of Minnesota Pollution Control Standards, Minnesota Rules <br />as amended except as modified herein by City performance <br />6. Furnace Emissions and Monitoring. Emissions from the melt furnace shall comply <br />with State and Federal regulations as they exist and may be modified from time to time <br />during the period of this CUP. An independent testing laboratory shall conduct emissions <br />monitoring at least once per year or on a more frequent basis if pollutants are in excess of <br />standards. The Permit Holder shall make a complete report available to the City within <br />_84_ <br />1 <br />
