Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #93 -03 -033 A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, INC. BASED ON RESOLUTION #93 -02 -023 ADOPTING FINDINGS OF FACT #0329 AND DECLARING TERMS OF CONDITIONAL USE PERMIT WHEREAS, the consideration of approval for the request for a conditional use permit amendment is based on the City's determination that the amendment is consistent with the intent and purposes of Chapter 9.03.04 (Conditional Use Permits) of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On March 9, 1993, an amended conditional use permit ( "CUP ") was approved for issuance by the City of Ramsey ( "City ") to Danny's Aluminum Processing, Inc. ( "Permit Holder ") to expand the operations of the aluminum processing facility to include the disassembly of engines and transmissions on the property general known as 14050 Basalt Street N.W. and legally described as follows: Lot 1, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota, hereinafter "site ". This permit is issued pursuant to Section 170.013D of the Ramsey City Code. The conditions of this permit are as follows: 1. Term. This permit shall remain in effect so long as the conditions imposed herein are complied with. 2. Noise. Noises emanating from the site and operations shall be in compliance with and regulated by the *State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. 3. Dust/Ash /Particulates. The emission of dust, ash or other particulate matter shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Part 50, as amended except as modified herein by City performance requirements. 4. Odor. The emission of odor from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as modified herein by City performance requirements. 5. Smoke. The emission regulated by the State 7005.0480 subp. l.B., requirements. of smoke from the operation shall be in compliance with and , of Minnesota Pollution Control Standards, Minnesota Rules as amended except as modified herein by City performance 6. Furnace Emissions and Monitoring. Emissions from the melt furnace shall comply with State and Federal regulations as they exist and may be modified from time to time during the period of this CUP. An independent testing laboratory shall conduct emissions monitoring at least once per year or on a more frequent basis if pollutants are in excess of standards.
