restitution (either in the form of reforestation and/or payment into the <br />Community Forestry Fund); and <br />(vi) Grading, Drainage and Erosion Control plans, prepared by a Professional <br />Engineer; and <br />(vii) Provided the CITY with a copy of the requisite Anoka County permit(s) <br />for driveway and culvert installation; and <br />(viii) Documentation that the lowest floor meets the groundwater and floodplain <br />separation requirements. <br />(ix) Review of civil plans is typically completed as part of the subdivision <br />review process, and the cost incurred by the CITY is covered through an <br />escrow established by the PERMITTEE. Since much of this review <br />(stormwater management, grading, tree preservation, etc.) now will be <br />completed as part of the building permit review due to the PERMITTEE's <br />desire to custom design/build each lot within this development, a `civil <br />plans review fee of Three Hundred Dollars and No Cents ($300) per lot <br />must be provided. <br />b. No occupancy permit for any lot in the Plat shall be issued until the PERMITTEE <br />has: <br />(i) Constructed vehicular access to the lot, including the installation of at least <br />one layer of bituminous surfacing; and <br />(ii) Constructed all utilities and storm water facilities this Agreement requires <br />to serve the lot and such utilities and storm water facilities are in place, <br />operational and approved by the CITY; and <br />(iii) For lots that have a slope of less than 2%, provided the CITY with a <br />certificate of grading, prepared by a licensed (State of Minnesota) <br />professional land surveyor, certifying that the flattest grade on the lot is I % <br />or greater; and <br />(iv) Installed and planted the sod and landscaping that are required as a part of <br />the Stage I Improvements; and <br />(v) Provided an As -Built Certificate of Survey, with grading and setbacks <br />marked, to ensure that individual stormwater basins have been constructed <br />in accordance with approved plans and to ensure positive drainage away <br />from a home's foundation; and <br />(vi) Recorded a Stormwater Maintenance Agreement against said lot; and <br />(vii) Provided the required escrow(s) if certain improvements, including but not <br />necessarily limited to, landscaping and driveway, have not been installed <br />yet. <br />17. PERMITTEE Defaults. If the PERMITTEE defaults in the performance of one or more <br />of the PERMITTEE'S obligations under this Agreement, i) the CITY gives the <br />PERMITTEE thirty (30) days written notice of the default and ii) the PERMITTEE fails <br />to cure the default within said thirty (30), then the CITY may pursue any and all remedies <br />available at law or in equity including, but not limited to, the following: <br />a. The CITY may, at its option, perform or engage one or more third parties to <br />perform the PERMITTEE'S obligations. If, in the reasonable judgment of the <br />CITY' S staff, the PERMITTEE'S default creates an immediate risk to public <br />health or safety, the CITY may perform or engage one or more third parties to <br />perform the work before the CITY provides the notice described in the initial <br />paragraph of this Section, but the CITY must use commercially reasonable efforts <br />0 <br />
