Holiday would then be assessed for the improvement and that <br />assessment would include acquisition costs. If in the future the City does <br />construct the service road and if the right-of-way necessary is donated. <br />Holiday may consider the request in a different light; in the meantime. <br />Holiday has no intention of expanding it's development onto that rear <br />portion of the propert). planned for a service road and the City maintains <br />control of that through the site plan process. <br /> <br />The City's offer to enter into an agreement to convert the property back to <br />the property owner if the service road is not constructed \;'as also not <br />agreeable to Mr. Hoeschen. <br /> <br />Motion by Councilmember Sorteberg and seconded by Counc i Imember Bawden to <br />adopt Findings of Fact 0230 relating to Holiday Stationstores request for <br />site plan approval, amended as follows: <br /> <br />Add ~tem #15 to reflect that the developer bas indicated an <br />unwillingness to donate a 60 foot easement for frontage road/drainage/ <br />utility purposes. <br /> <br />Kotion carried. Voting Yes: Mayor Reimann. Councilmembers Sorteberg, <br />DeLuca. Pearson and Bawden. Voting No: None. <br /> <br />Hotion by Councilmemb er Bawden ands ec onded by Counc i lmemb er DeLuca to <br />approve the site plan for Holiday Stationstores. Inc. <br /> <br />Hotion carried. Voting Yes: ~1ayor Reimann, Councilmembers Sorteberg. <br />DeLuca, Pears on and Ba'lr.1den. Voting No: None. <br /> <br />With regards to the easement for frontage road/utilities. Mr. Goodrich <br />suggested that another option would be to include encumbering language in <br />the development agreement which would allow the City to purchase the <br />easement in the future at 1988 prices or less. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Pears on to <br />authorize the Mayor and the City Administrator to enter into a development <br />agreement with Eoliday Stationstores.
