The Planning and Zoning Commission has recommended approval of the request. Mayor Reimann suggested requiring a bond or letter of credit to def ray the legal costs incurred by the City if the Brozak's refuse to cease the operation in one year. COuncil consensus was that requiring a bond should first be researched and then established asa general policy. Motion by COuncilmember Sorteberg and seconded by COunci1member DeLuca to adopt Findings of Fact 0197, amended as fo11CMs, relating to Mark and LuAnn Brozak's request for a conditional use permit: (Please refer to findings of fact file for Findings of Fact 0197). Item *8 - Change to read as follCMs: 'That the Appl icant has stated that the print shop would be a pick-up and delivery business; the majority of the business would be done over the telephone. There would be no drop-in bUBiness. Motion carried. Voting Yes: DP.T.,1.lcaand Pearson. Voting No: Mayor Reimann, Councilmembers Sorteberg, None. Further Discussion: LuAnn Brozak was present and stated she agrees with the terms in the conditional use permit and guaranteed she will not operate the b'..lSiness for more than one year at her horne. Council amended Item #1 of the conditional use permit to indicate an expiration date of March 22, 1989. Motion carried. Voting Yes: Councilmernbers Sorteberg, DeLuca and Pearson. Case #2: Request For Conditional Use Permit To Construct A~ Advertisina Sign: Case Of Mr. Timothv Shav: Ms. wrris stated that Mr. Shay is requesting to construct an advertising sign on his vacant property at 6745 l38th Avenue N.W.; there is currently a sign existing on the property.
