<br />7. '!bat Section 170.05 of the City Code {:ermits a maximum of 100 square <br />feet for free standing signs in commercial areas. <br /> <br />8. That there are currently two free-standing signs on the subject <br />property. <br /> <br />9. '!bat Section 170.05 of the City Code allCMs one free-standing sign per <br />street frontage on a site. <br /> <br />10. '!bat the Applicant is proposing to construct the proposed sign on one <br />of the signs currently located on the subject pro{:erty. <br /> <br />11. That the Applicant has stated that such variance is necessary to <br />pro{:erly advertise the facility located on the subject pro{:erty. <br /> <br />12. That if granted, the variance will grant the Applicant special <br />privileges that are denied by the City Code to other properties in the <br />area, s{:ecifically, that there will be two free-standing signs on the <br />pro{:erty and the total signage will exceed the {:ermitted signage specified <br />in Section 170.05 of the City Code. <br /> <br />13. That the Applicant has stated that there are special conditions <br />applying to the subject property, namely that the subject property is <br />located on Highway 10 and there is a great deal of traffic moving at a high <br />sp=ed; therefore, a larger sign is needed than is permitted by City <br />Code. . <br /> <br />14. That at the time the proposed sign was previously displayed on the <br />property, it was a non-conforming use; that sign was removed from the <br />property as the gas service on the sign was no longer in operation. <br /> <br />15. Tnat Section 170.01SH of the City Code requires any non-conforming use <br />that is discontinued for a period of 12 months to conform to the <br />regulations of O1apter 170.01 before the use may be re-established. <br /> <br />The motion for the adoption of the foregoing findings of fact was duly <br />seconded by Commissioner Howell and upon vote being taken thereon, the <br />following voted in favor thereof: <br /> <br />O1airman Sht.:lITMay <br />Commissioner Hendriksen <br />Commissioner Howell <br />Commissioner LaDue <br />Commissioner ZiImrerrnan <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the fOllowing abstained: <br /> <br />None <br /> <br />and the following \-lere absent: <br /> <br />Cornrr~ssioner Holm <br />Commissioner ~crry <br /> <br />1Jo <br />
