Board of Adjustment public hearing minutes dated April 27, 1988 <br />regarding George Pepek' s request for a variance. <br /> <br />2. Board of Adjustment public hearing minutes dated April 27, 1988 <br />regarding Amoco Oil Company's request for a variance. <br /> <br />3. Board of Adjustment regular meeting minutes dated April 27, 1988. <br /> <br />Motion carried. Voting Yes: Chairman Sh1.lIIMay, Commissioners Terry, Holm, <br />Zimmerman and Sh1.lIIMay. Voting No: None. Absent: Commissioners Howell <br />and Hendriksen. <br /> <br />roARD OF ADJUSTMENI' BUSINESS <br /> <br />Case #1: Request For Variance From Section 170.076 Of The City Code <br />To CQnstruct A Deck Which Will Encroach On The Required <br />Setback From The Rum River Setback: Case Of Ken And Sandy <br />YQJ.fu <br /> <br />Ms. Norris noted that the VoId hane waS constructed in 1978 and the deck <br />was in compliance until the City adopted the Scenic River overlay district <br />in 1981. <br /> <br />Motion by Corrunissioner Holm and seconded by Commissioner Terry to amend the <br />prorx>sed findings of fact as follOWS: <br /> <br />Item #17: That the hardship in this case would be that the house was <br />built in 1978 and complied with codes; the adoption of the <br />Scenic River overlay district in 1981 creates a problem <br />with the expansion of the deck. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Holm and LaDue. Voting No: None. Absent: Commissioners <br />Hendriksen and Howell. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner LaDue to <br />adopt Findings of Fact 0205, as amended, relating to Ken and Sandy VoId's <br />request for a variance. (Please refer to findings of fact file for <br />Findings of Fact 0205). <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, LaDue and Holm.
