<br />10 Minutes <br /> <br />CASE #6: <br /> <br />SERVICE AVAILABn..ITY ~ (SAC) REFUIDS <br />By: Dave Hartley, City Administrator <br /> <br />Background: . <br /> <br />The City Council has instructed Staff to prepare an application to the <br />Metropolitan Waste Control Commission for a refund of SAC charges which have <br />been made to pro~rties where sanitary sewer service is not available. <br /> <br />In its previous action, the Council indicated that a request for funds would be <br />made; however, the City would retain the funds generated f rom the request for <br />reinbursernent. Since that time, several other communities have also requested <br />a refund fran the Metropolitan Waste Control Commission and are in the process <br />of refunding to the individuals the p;l.yrnents which were made. This practice <br />has generated a noticable response f rom Ramsey residents. The most common <br />response is that the individual property owners would like to receive the <br />refund rather than the City of Ramsey. <br /> <br />Enclosed is a list of those properties which have paid a Service Availabil i ty <br />Charge and do not currently have access to sanitary sewer. Please note that <br />within this list, a single asterick (*) indicates that the property will have <br />sewer available within the year. In these cases it is not advisable for the <br />City Council to request a refund since the current rate for the SAC charge is <br />higher than past rates. <br /> <br />Additionally, the City Council should note that if the City of Ramsey retains <br />the Service Availability Charge, then at such time in the future that a <br />property may receive sanitary sewer service, the City will be responsible for <br />paying the Service Availability Charge at the future rate which is likely to be <br />higher than any of the rates charged previously. However, if the SAC charge is <br />returned to the property owner, then it is the responsibility of the property <br />owner to p;l.y the future rate. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br /> <br />Motion to: <br />Authorize the City Administrator to make application to the Metropolitan <br />Waste Control Commission for a refund of $92,557.00 for Service <br />Availability Charges. <br /> <br />Review Checklist : <br /> <br />Administrator ~ <br />Attorney <br />Engineer <br />Community Developnent Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Building Official <br /> <br />.L <br /> <br />frJl <br />
