<br />(k) The organization licensed to conduct gambling shall have exclusive <br />control over all gambling devices, money, and records. Whenever the <br />organization is not present or specifically represented by its agent, all <br />gambling devices, money, and records shall be securely locked and shall <br />be inaccessible to employees of the gambling location; <br /> <br />(1) No gambling funds shall be commingled with funds of the gambling <br />location; <br /> <br />(m) No food, drink, or entertainment discounts or other promotions shall <br />be offered in conjunction with the sale of gambling devices or chances; <br /> <br />(n) The gambling location shall allow the organization to conduct <br />gambling at any time during its lawful business hours and shall prohibit <br />gambling at any time other than its lawful business hours; <br /> <br />(0) The owner or operator of a gambling location shall make no <br />agreements with any gambling equipment distributor requiring the use of <br />his or her gambling equipment in the establishment; <br /> <br />(p) The City Council may disapprove a gambling license application for <br />an establishment in which gambling violations have previously occurred. <br /> <br />130.125. Investigation. Every organization which files an application <br />for issuance or renewal of a charitable gambling license shall deliver the <br />application to the City Administrator. The City Administrator shall <br />investigate each application and report any findings and recommendations <br />to the City Council. <br /> <br />130.126. Filing of records; inspection; access to records. <br />(a) Every organization licensed to conduct gambling in the City of <br />Ramsey shall file with the City Administrator copies of all records and <br />reports required to be filed with the Minnesota Charitable Gambling <br />Control Board pursuant to Minnesota Statutes, Chapter 349 and the rules <br />and regulations promulgated thereunder. The records and reports shall be <br />filed in the office of the City Administrator at the same time they are <br />due to the Board; <br /> <br />(b) Every gambling event in the City of Ramsey conducted by an <br />organization under Minnesota Statutes, Chapter 349 shall be open to <br />inspection by officers of the Ramsey Police Department; <br /> <br />(c) The City Administrator or employees of the Police Department, at the <br />direction of the City Administrator, may inspect at any reasonable time, <br />without notice or search warrant, all records of a licensed organization, <br />including gambling account and other bank records required by the <br />Minnesota Charitable Gambling Board to be maintained and preserved. <br /> <br />SECTION 2. SEPARABILITY. <br /> <br />Should any section or prOV1S1on of this ordinance be declared by a court <br />of competent jurisdiction to be invalid, such decision shall not affect the <br />validity of the ordinance as a whole or any parts thereof, other than the parts <br />so declared to be invalid. <br /> <br />18 <br />
