Councilmember Cox stated that if the property owners feel they are being forced to develop, then the alignment should be revised to follow the highway right"-of-way; in fairness to those developers that have paid and those that will, a large amount of money should not bj~ paid for these easements. Case #6.A: Ken Miller Well Problem: Mr. Hartley stated that Mr. Ken Miller's 20 foot well bas lost it's water prOduction capability; tbe well is in tbe area where sewer and water construction is taking place; that construction included dewatering. Mr. Raatikka noted tbat dewatering ceased about one montb ago and the water table is back to within one foot of where it was tbe first part of September. Attempts have been made to pump Mr. Miller's well, but tbe quantity of water was low and contained a lot of sand; the well is 37 years old, bas had no repairs to it, does not meet code and it's questionable that it will recover. Mayor Reimann inquired if there is proof that the well was functional before sewer and water construction began. M::. Hartley statedt.hat the burden of proof would be on the part of the city to prove the well was not functional prior to construction in the area; the city does not have that evidence. Mr. Hartley suggested that a solution might be to enter into an a~reement with Mr. Miller that when his property changes hands, water connection charges and pending assessments would be paid but during the interim he would be allowed to connect to the service and pay user fees for water. Councilmember Cox stated that the subject well bas a history of malfunction and not being acceptable for human consumption; Kr. Miller bas admitted, within the last 3 montbs, to not being able to use tbis well and having to buy bottled water all tbis time. Historically, the well is not acceptable and the taxpayers sboult not have to pay for Mr. Miller's situation. Councilmember Cox also noted tbat dewatering would not cause the well to pump sand. Motion by Councilmember DeLuca and seccncec oy Sc~teberg directing city staff to researcb the history of Mr. Ken Miller's well and report back to Council on December 8, 1987. Motion carried.
