Voting No: None. <br /> <br />Case ~14: Enfor~~me~t Of B~ildinr Code Re~ardin~ Automatic SDrinkler <br />Systems: <br /> <br />Mr. Hartley stated that the automatic sprinkler system requirement has been <br />brought up for discussion as a result of current remodelling being done at <br />LeTourneau's Super Valu on 167th. The Building Code states that any <br />building being built or rem4delled is required to install a sprinkling <br />system and that requirement is not exclusive to areas having municipal <br />sewer and water. Building Official Erickson is offering that although the <br />city cannot deviate from Stste Building Code and expect him to maintain his <br />certification. the city can consider allowing the construction of a <br />sprinkler system with an outlet for use by the fire department and the <br />pressure tank of the system being installed at a later date. <br /> <br />Mayor Reimann recalled tbat in tbe past. tbe city waived tbe automatic <br />sprinkling system requirement. <br /> <br />Mr. Goodrich agreed and stated tbat he would have to contact the former <br />building inspector to determine tbe rationale those waivers were bas ed on. <br />Mr. Erickson has also noted that the city recently adopted tbe 1985 DBC <br />code and waiving of sprinkler system requirements might have been allowed <br />for under the 1976/79 DEC that was in effect at the time of those wai.., ings. <br /> <br />Mr. Erickson noted that Rum River and River's Bend Plazas were not required <br />to install sprinkler syste~s because each of the cer.ters have a 1 tour <br />occupancy separation vall to keep each area undertbe maximum of 12.000 <br />square feet where a sprinkler system would be required in a B-2 occupancy. <br /> <br />Mr. LeTourneau stated that he submitted plans and specs and made building <br />pe~it ~??lication about 7 weeks age end ~as given a verbcl go-ahead for <br />construction; 7 weeks later the city requires tbe sprinkler system tba~ <br />~ill cost about $50.000; tbe remodelling cost is already up to $250.000; if <br />be bad known of tbe sprinkler sys~em requirement. be might not bave gone <br />ahead with tberemodelling project. <br /> <br />Hr. Goodrich stated he bas a copy of a letter to Mr. LeTourneau's <br />architect dated Octo~er 27.1987 stating that en a~~omatic sprinkler syste~ <br />would be required. <br /> <br />Mr. Erickson stated that directly after be found out there was construction <br />going on at the store. Mr. LeTourneau applied for a building permit on <br />September 24,1987.
