Councilmember Cich introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-12-270 <br /> <br />RESOLUTION AUTHORIZING VACATION OF STREET RIGHT-OF-WAYS ACROSS <br />OUTLOTS C AND D OF NORTHFORK. <br /> <br /> WHEREAS, certain street right-of-way easements have been acquired by the City during the <br />development of Northfork P.U.D.; and <br /> <br />and <br /> <br />WHEREAS, certain street easements are no longer necessary for use by the City and public; <br /> <br /> WHEREAS, the original need by the City for said easements has been replaced by other <br />easements which adequately address the City's requirements; and <br /> <br />and <br /> <br />WHEREAS, the developer of Northfork P.U.D. has requested the City vacate said easements; <br /> <br /> WHEREAS, M.S.A. 412.851 entitled Vacation of Streets permits the City Council to vacate <br />public grounds and public ways; and <br /> <br /> WHEREAS, on December 3, 1991, the Planning and Zoning Commission held a public <br />hearing regarding the issue of vacating said easements in Northfork P.U.D., which public hearing was <br />preceded by two weeks public notice in the Anoka County Union and posted notice, and at which public <br />hearing all members of the public present were given the opportunity to be heard; and <br /> <br /> WHEREAS, after consideration of all relevant factors, the City Council finds that it is in the <br />best interest of the public to vacate said street right-of-way easements. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the street right-of-way easement legally described as follows is hereby vacated to wit: <br /> <br />A 66.00 easement for roadway purposes over, under and across that part of Outlot C, <br />NORTHFORK embraced within the Northeast Quarter of Section 18, Township 32, Range 25 and <br />that part of Outlot C, NORTHFORK embraced within the West Half of the Northwest Quarter of <br />Section 17, Township 32, Range 25, said roadway to lead from Andrie Road at the Southwest <br />corner Of Lot 2, Block 3, NORTHFORK easterly to existing 164th Avenue in WOODLAWN <br />ESTATES; all in the City of Ramsey, County of Anoka, State of Minnesota. <br /> <br />2) That the street right-of-way easement legally described as follows is hereby vacated to wit: <br /> <br />A 66.00 foot easement for roadway purposes over, under and across Outlots C and D, according to <br />the plat of NORTHFORK on file in the Office of the Registrar of Titles, Anoka County, Minnesota. <br />The centerline of said easement is described as follows: <br /> <br />Commencing at the most easterly corner of said Outlot D; thence North 89 degrees 12 minutes 26 <br />seconds West, record bearing, along the southerly line of said Outlot D 264.25 feet; thence North 79 <br />degrees 59 minutes 27 seconds West along said southerly line 290.76 feet to the point of beginning <br />of the centerline to be described; thence northeasterly 194.86 feet along a non-tangential curve, <br />concave to the northwest, having a radius of 380.00 feet, a central angle of 29 degrees 22 minutes 52 <br />seconds, and the chord of said curve bears North 14 degrees 44 minutes 06 seconds East; thence <br /> <br /> <br />
