Assistant Community Development Director Frolik replied a resident came to City Hall today, <br />but it was not in relation to the size of the garage. The neighboring property owner has a garage <br />that slightly encroaches onto the Hamborg property line. The size of Mr. Hamborg's garage has <br />no relation to resolving that property line issue. <br />Commissioner Cleveland asked if there is a possibility that Mr. Hamborg's accessory building <br />would be too close to the property line in the future due to the neighboring property owner's <br />garage. <br />Mr. Hamborg replied his accessory structure will be 15 feet from the property line. <br />Commissioner Levine noted the neighbor's garage is an unrelated issue from Mr. Hamborg's <br />request. <br />Chairperson Nixt commented individuals own large parcels to accommodate hobbies and <br />activities, and one of those activities may involve the need for storage space. He indicated he <br />would be inclined to grant the permit request. <br />Commissioner Levine concurred. He commented from an aesthetic standpoint the neighbors <br />would likely prefer to see things enclosed. <br />Commissioner Trites Rolle noted from the photographs it appears that the structure will not be <br />very visible from the road. <br />Chairperson Nixt indicated he would suggest a recommendation that the City Council adopt <br />findings of fact favorable to the applicant's request for a conditional use permit to construct the <br />accessory building, which would cause an overage of 860 square feet. <br />Ms. Barbara Stanke stated she owns the property to the right of Mr. Hamborg. She explained <br />they had not known that their garage encroaches on Mr. Hamborg's property. She asked how far <br />Mr. Hamborg's new garage will be from their present garage. <br />Chairperson Nixt replied Mr. Hamborg's structure will be 15 feet from the property line. He <br />asked if the concern is that Mr. Hamborg's structure will be too close to the Stanke's garage. <br />Ms. Stanke replied she knows they have an issue with their garage being on Mr. Hamborg's <br />property. <br />Assistant Community Development Director Frolik advised the minimum setback from the <br />property line is 10 feet. <br />Chairperson Nixt stated in theory a 3 foot strip could be carved off of Mr. Hamborg's property <br />for the Stanke's. This could solve the Stanke's legal issues, and Mr. Hamborg would still meet <br />his side -yard setback. There appears to be flexibility to solve the issue if that were to be the <br />proposed solution.
