Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Howell and LaDue. Voting No: None. Abstain: Commissioner <br />Hendriksen. Absent: Commissioner Holm. <br /> <br />Case #2: Request For Variance From Section 170.076 Of The Ramsey City <br />Code To Encroach On The Required Setback From The Rum River; <br />Case Of Mr. Dean Hanson: <br /> <br />Mr. Dean Hanson was present requesting a variance in order to construct a <br />home on Lot 4, Block 1, Reilley Estates, approximately 103 feet from the <br />Rum River. Mr. Hanson referred to a letter John Stine of the DNR dated <br />July 5, 1988. Mr. Hanson stated that the letter was under the assumption <br />that the walkout side of the two-story home would be on the river side and <br />that excessive structure height would be visible from the river. Mr. <br />Hanson stated that on July 7 he explained to Mr. Stine that the walkout <br />side of the home would not be on the river side and Mr. Stine then seemed <br />agreeable to the proposed location of the home. <br /> <br />Commissioner Zimmerman stated that he also talked with Mr. Stine regarding <br />Mr. Hanson's request and he was also of the opinion that the topography <br />constraints on the lot do not constitute a hardship. <br /> <br />Mr. Hanson stated that the tree line along the river bluff will not be <br />removed and his home will not be visible from the river. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Howell to add <br />language to Item #10 of the proposed findings of fact to indicate that a <br />letter was also received from Mrs. Gary Martinson, a property owner to the <br />north, opposing the granting of a variance which would create a river <br />setback less than hers, which is 127 feet. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Howell, LaDue and Hendriksen. Voting No: None. Absent: <br />Commissioner Holm. <br /> <br />Mr. Tarnowski - Stated that he owns the property to the south of Mr. <br />Hanson's and that comments in Mrs. Martinson's letter regarding the <br />proposed location of Mr. Hanson's home ruining the scenic landscape are <br />untrue. Mr. Tarnowski noted that his home is located 80 feet from the <br />river and not visible from the river. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Terry to adopt <br />Findings of Fact 0210, as amended, relating to Dean Hanson's request for a <br />variance. (Refer to findings of fact file for Findings of Fact 0210.) <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Howell, LaDue and Hendriksen. Voting No: None. Absent: <br />Commissioner Holm. <br /> <br />Mr. Hanson stated that there is a sharp slope on the street side of the lot <br />and moving the house closer to the street will result in a driveway grade <br />Board of Adjustment/July 7, 1988 <br /> <br />Page 4 of 5 <br />
