Absent: Commissioners Holm <br />and Hendriksen. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Terry to create <br />a new Item #13 in the proposed findings of fact to read as follows: 'That <br />Section 170.016B of the Ramsey City Code was adopted in 1986 and the <br />Applicants built and took possession of their home on the subject property <br />in 1987.' <br /> <br />Motion carried. Absent: Commissioner Holm. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Howell to add <br />Item #17 to the proposed findings of fact to read as follows: 'That if the <br />variance is granted, the 8 foot setback added to the 12 foot boulevard <br />would still meet the intent of the City Code to have at least a 20 foot <br />setback from the street to any structure to allow for visibility from the <br />street.' <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Howell and LaDue. Voting No: None. Abstain: Commissioner <br />Hendriksen. Absent: Commissioner Holm. <br /> <br />Discussion ensued regarding the fact that corner lots are subject to more <br />stringent side yard setback requirements creates the hardship in this case. <br /> <br />. Motion by Commissioner LaDue and seconded by Commissioner Terry to adopt <br />Findings of Fact 0209, as amended, relating to Keith and Barbara Rakos' <br />request for a variance. (Refer to findings of fact file for Findings of <br />Fact 0209). <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, Howell and LaDue. Voting No: None. Abstain: Commissioner <br />Hendriksen. Absent: Commissioner Holm. <br /> <br />Commissioner Howell suggested that the Rakos' consider building their deck <br />10 feet rather than 12 feet wide in order to have a 10 foot side yard like <br />other non-corner lots in the area. <br /> <br />Mrs. Rakos explained that they were not aware a building permit and <br />variance would be necessary; the deck is already framed in at 12'x32'. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Howell to amend <br />the proposed variance as follows: Add Item #4 to indicate that there shall <br />be no enclosure or shrubbery beneath the deck that would obstruct <br />visibility from the streets. <br /> <br />Motion carried.
