Board of Adjustment regular meeting minutes dated January 27, 1987. <br /> <br />Motion carried. Voting Yes: Chairman Zirrmerman, Cormnissioners ShtmlWay, <br />Peterson, Deemer, Hendriksen, Howell and LaDue. Voting No: None. <br /> <br />FOARD OF ADJUSTMENl' BUSINESS <br /> <br />Case #1: ReQuest For Variance From Side Yard Setback ~ Case Of Mr. Lyle <br />MCLaughlin For River's Bend PrQperties: <br /> <br />. <br /> <br />The Board proceeded to review the proposed findings of fact. <br /> <br />Motion by Cormnissioner Hendriksen and seconded by Cormnissioner Peterson to <br />amend Item #9 of the proposed findings of fact as follows: <br /> <br />9. That the Applicant has stated that there are unique circumstances <br />applying to the subject property, namely, the width of the <br />drainage easement on the northern boundary that was not reflected <br />on the certificate of lot survey. <br /> <br />Motion carried. Voting Yes: Chairman Zinunerman, Commissioners Deemer, <br />Peterson, Shmnway, Hendriksen, Howell and LaDue. Voting No: None. <br /> <br />Motion by Cormnissioner Hendriksen and seconded by Commissioner Deemer to <br />amend Item ill of the proposed findings of fact as follows: <br /> <br />That the special conditions, namely the drainage easement and pipe <br />and anission of easement fran certificate of lot survey, do not result <br />fran the actions of the Applicant. <br /> <br />Motion carried. Voting Yes: Chairman Zinunerman, Commissioners Peterson, <br />Deemer, Shmnway, Hendriksen, Howell and LaDue. Voting No: None. <br /> <br />Motion by Cormnissioner Deemer and seconded by Cormnissioner ShtmlWay to adopt <br />Findings of Fact 0156, as amended, relating to Mr. McLaughlin's request for <br />a variance from the side yard setback requirement. (Please refer to <br />findings of fact file for Findings of Fact 0156). <br /> <br />Motion carried. Voting Yes: Chairman Zinunerman, Commissioners Deemer, <br />Peterson, ShUIlMay, Hendriksen, LaDue and Howell. Voting No: None. <br /> <br />The Board proceeded to review the proposed variance. <br /> <br />Cormnissioner Deemer expressed concern with accessory structures being added <br />to the property that would also encroach on the 10' southern side yard <br />setback. <br /> <br />. <br /> <br />Ms. Norris stated that the property is in the jurisdiction of the Scenic <br />Board of Adj ustmentjFebruary 26, 1987 <br /> <br />Page 2 of 3 <br />
