Parent Company. <br /> <br />Chairman Zimmerman called the regular meeting back to order 7:56 p.m. <br /> <br />APPROVAL OF BOARD OF ADJUSTMENT MEETING MINUTES <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Zimmerman to <br />approve the following minutes: <br /> <br />1) Board of Adjustment public hearing minutes dated August 27, 1987 <br />regarding Mr. Triemert's request for variance from Sections <br />170.015F and 170.016A of the City Code. <br /> <br />2) Board of Adjustment public hearing minutes dated August 27, 1987 <br />regarding A.J. Parent Company's request for a variance from <br />Section 170.076.24 of the City Code. <br /> <br />3) Board of Adjustment regular meeting minutes dated August 27,1987. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />LaDue, Terry, Holm and Hendriksen. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />BOARD OF ADJUSTMENT BUSINESS <br /> <br />Case #1: Request For Variance From Sections 170.015F And 170.016A Of <br />The City Code Regradin~ Setback From Thoroughfares; Case Of <br />Mr. Ronald Fischl: <br /> <br />Mrs. Fischl and her contractor, Bruce Risdal of United Merchandising, were <br />present requesting a variance to construct an above-ground swimming pool in <br />the front yard at 15850 St. Francis Blvd., approximately 85 feet from the <br />centerline. The required setback from St. Francis Blvd. is 110 feet. <br />Mr. Risdal noted that the pool is already partially constructed and would <br />be difficult to move; the present location of it is the only feasible <br />location on the entire property. <br /> <br />The Commission reviewed the proposed findings of fact. <br /> <br />It was noted that a variance is granted to the property and would not lapse <br />when the property is sold or the pool is removed. Also, according to the <br />definition of a structure, the variance is not limited to a pool but rather <br />anything that is constructed or erected. <br /> <br />Motion by <br />Findings <br />variance. <br />0179). <br /> <br />Commissioner LaDue and seconded by Commissioner Holm to adopt <br />of Fact 0179 relating to Mr. Ronald Fischl's request for a <br />(Please refer to findings of fact file for Findings of Fact <br /> <br />Further Discussion: Commissioner Hendriksen stated that it appears by <br />aerial photos that there are other feasible locations for the pool.
