<br />. <br /> <br />. <br /> <br />. <br /> <br />location will have an adverse impact if improvements are made to Hwy. #47. <br />Mr. Risdal stated that the pool is only 15 feet closer to the road than the <br />house is. <br /> <br />The following item was added to the findings of fact: <br /> <br />#15. That the applicant has stated that due to the location of the <br />septic system, underground tank, topography of the lot, tree <br />line and pasture, the pool is situated in the only feasible <br />location on the property. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />LaDue, Terry, Holm and Hendriksen. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Holm to <br />approve Mr. Ronald Fischl's request for a variance with the following <br />term added: <br /> <br />#2. This variance shall not be construed to imply that the property <br />owner can build an in-ground pool or any other permanent <br />structure at this location. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />LaDue, Terry, Holm and Hendriksen. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Case /F2: Request For Variance From Section 170.076.24 Of The City Code <br />Re~ardin~ Setback From The Rum River; Case Of Mr. Marshall <br />Pearson Of Re~ency Homes. Inc.: <br /> <br />Mr. Gary Uhde was present representing Marshall Pearson of Regency Homes. <br /> <br />Chairman Zimmerman expressed displeasure with the unprofessional way in <br />which the home was staked out and that nobody determined that there is also <br />a scenic river easement, held by the city, that was also being encroached <br />upon. <br /> <br />Mr. Uhde noted that the scenic river easement is not reflected on plats <br />that his company has; his firm is very experienced with commercial and <br />residential development and approvals necessary from outside agencies; this <br />particular case was an error and not intentional. <br /> <br />The Commission reviewed the proposed findings of fact. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Holm to adopt <br />Findings of Fact 0180, amended as follows, relating to Mr. Marshall <br />Pearson's request for a variance: <br /> <br />Item #6 should state that the home is located approximately 70 feet <br />from the Rum River. <br /> <br />Item #8 should state that the Applicant is requesting a variance of <br />approximately 80 feet to the Rum River setback requirement. <br /> <br />Board of Adjustment/September 24, 1987 <br /> <br />Page 3 of 7 <br />
