Absent: Commissioners Hendriksen, <br /> <br />Case #1: Request For Variance From Section 170.016B Of The City Code <br />Reiardini Required Rear Yard Setback; Case Of Mr. And Mrs. <br />Bruno Brettschneider: <br /> <br />Mr. and Mrs. Brettschneider were present requesting a variance to encroach <br />the rear yard setback by approximately 7 feet in order to construct a porch <br />on their home at 14884 Waco Street N.W. Mr. Brettschneider stated that he <br />has acted as the contractor in having this home built for him. <br /> <br />Mrs. Brettschneider stated that there is a discrepancy of about 2.5 feet <br />between the certified lot survey and the actual location of the stakes on <br />the property; added that her neighbors have experienced the same problems <br />with survey discrepancies. <br /> <br />The Board reviewed the proposed findings of fact. <br /> <br />Commissioner Zimmerman noted that a hardship must be determined to exist in <br />order to approve a variance request; the criteria for hardship is physcial <br />characteristics of a lot that limit use of the lot; hardship cannot be <br />based on financial or personal reasons. <br /> <br />. <br /> <br />Chairman Shumway stated he viewed the subject property and feels that the <br />need for a variance could have been avoided by situating the home on the <br />lot differently or by not building a home too large for the lot.
