<br />. <br /> <br />. <br /> <br />. <br /> <br />Shumway noted that the patio doors are already installed and it appears the <br />Brettschneiders assumed the variance would be automatic. <br /> <br />Chairman Shumway suggested deleting Item #9 from the findings of fact <br />regarding the granting of the variance not being materially detrimental to <br />the purposes of the zoning chapter. <br /> <br />Commissioner Zimmerman suggested that the finding be amended to read that <br />the granting of the variance may be detrimental to the purposes of the <br />zoning chapter. Chairman Shumway stated that granting a variance with no <br />proof of hardship is detrimental to the purposes of the zoning chapter. <br />Commissioner Zimmerman inquired if there are any physical characteristics <br />on the Brettschneider property that would create a hardship. Mr. <br />Brettschneider stated that the physical layout of the property dictated <br />where the home could be built as a walkout. <br /> <br />Motion by Chairman Shumway to amend Item #9 of the findings of fact to <br />indicate that the granting of the variance will be detrimental to the <br />purposes of the zoning chapter. <br /> <br />Motion failed for lack of a second. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner LaDue to <br />amend Item #9 of the findings of fact to indicate that granting of the <br />variance m~ be detrimental to the purposes of the zoning chapter. <br /> <br />Motion carried. <br />LaDue and Terry. <br />Howell and Holm. <br /> <br />Voting Yes: <br />Voting No: <br /> <br />Chairman Shumway, Commissioners Zimmerman, <br />None. Absent: Commissioners Hendriksen, <br /> <br />Commissioner LaDue inquired if the porch was part of the original home <br />blueprints or an after-thought. <br /> <br />Mr. Brettschneider stated that the porch was part of the original <br />blueprints but when it was determined that the porch would encroach the <br />rear yard setback, the building permit for the porch was separated from <br />that of the house application so that construction of the principal <br />structure could begin. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Terry to add <br />Item #11 to the findings of fact to read as follows: 'That the building <br />permit for the porch was applied for after the building permit for the <br />principal structure was issued.' <br /> <br />Motion carried. <br />LaDue and Terry. <br />Howell and Holm. <br /> <br />Voting Yes: <br />Voting No: <br /> <br />Chairman Shumway, Commissioners Zimmerman, <br />None. Absent: Commissioners Hendriksen, <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Terry to add <br />Item #12 to the findings of fact to read as follows: 'That no proof of <br />hardship has been forthcoming from the Applicant.' <br /> <br />Motion carried.
