<br />. <br /> <br />. <br /> <br />. <br /> <br />permit to operate a landscaping nursery on his property at 16355 St. <br />Francis Blvd. His business requires him to be able to water his products <br />from April 1 to December 1; the well is located closer to the front lot <br />line than his home; he needs the accessory structure to store personal <br />recreational and lawn maintenance equipment; he would like to build the <br />accessory structure to serve a double purpose and house the well to prevent <br />freezing problems in the colder weather. The location of the proposed <br />accessory structure would be 149 feet from the centerline of St. Francis <br />Blvd. and 20 feet closer to St. Francis Blvd. than the principal structure. <br /> <br />Commissioner Terry arrived at this time. <br /> <br />Ms. Norris noted that Mr. Morton's proposed accessory structure location <br />would meet the 110 foot setback from throughfare requirement. <br /> <br />The Board proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Terry to <br />amend the following items in the proposed findings of fact to read as <br />follows: <br /> <br />Item #6 - That the Applicant is proposing to construct a 24' x 24' <br />garage which will be located approximately 20 feet in front of the <br />house, the principal structure. <br /> <br />Item #8 - That the Applicant is requesting a variance of approximately <br />20 feet from the requirement of Section l70.015G of the City Code. <br /> <br />Item #14 - That if granted, the variance will not endanger the public <br />safety or welfare nor will it interfere with future reconstruction to <br />St. Francis Blvd. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Holm, <br />Zimmerman, Hendriksen, LaDue and Terry. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Motion by Chairman Shumway and seconded by Commissioner Holm to add the <br />following items to the proposed findings of fact: <br /> <br />#16 - A petition, signed by 16 of Mr. Morton's neighbors, was received <br />and indicates no objection to the request being approved. <br /> <br />#17 - The proposed location for the accessory structure is 149 feet <br />from the centerline of St. Francis Blvd. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Holm, <br />Zimmerman, Hendriksen, LaDue and Terry. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner LaDue to <br />adopt Findings of Fact 0188 relating to Mr. Morton's request for a <br />variance. (Please refer to findings of fact file for Findings of Fact <br />0188). <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Holm, <br />Board of Adjustment/October 29, 1987 <br /> <br />Page 2 of 5 <br />
