Voting No: None. <br />Commissioner Howell. <br /> <br />Absent: <br /> <br />The Board proceeded to review the proposed variance. <br /> <br />Motion by Commissioner Holm and seconded by Commissioner Zimmerman to <br />approve Mr. Stanley Morton's request for a variance and that Item #1 of the <br />variance be amended to indicate that the accessory structure shall not <br />extend beyond the principal structure by more than 20 feet. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Holm, <br />Zimmerman, Hendriksen, LaDue and Terry. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Case #2: Request For Variance From Section 170.016B Of The City Code <br />Reiardin~ Required Rear Yard Setback; Case Of Mr. And Mrs. <br />Bruno Brettschneider: <br /> <br />Chairman Shumway recalled that this Board conducted a public hearing on <br />October 22 and tabled the case to allow Mr. Brettschneider time to provide <br />proof of hardship relating to his request for a variance from required rear <br />yard setback. <br /> <br />Mr. Brettschneider presented a memo from himself to the Board of Adjustment <br />requesting approval of a five foot variance to rear yard setback for <br />construction of a three-season porch and listing the following items he <br />feels constitute a hardship (see Attachment I). Mr. Brettschneider also <br />presented a signed statement from Mr. Rick Wyatt, an adjoining property <br />owner, stating no objection to the variance requested (see Attachment II). <br /> <br />Bruce West, Mr. Brettschneider's contractor, was present and stated that at <br />the time the building permit was applied for, the applicant was informed <br />that a variance would have to be applied for and not that a hardship would <br />have to be proved. Mr. West also noted that the original request was for a <br />7 foot variance but decreasing the garage size by 2 feet has decreased the <br />necessary variance to 5 feet. <br /> <br />Mr. Brettschneider stated that all other lots on that side of Waco have a <br />rear lot line wider than his (67.87 feet); the narrowing lot forced him to <br />place the home on the front portion of the lot in order to meet setback <br />requirements. <br /> <br />The Board reviewed the minutes of October 22, 1987 and Findings of Fact <br />0185 adopted October 22 relating to Mr. Brettschneider's request. <br /> <br />Motion by Commissioner Holm and seconded by Commissioner LaDue to amend the <br />following items in Findings of Fact 0185 to read as follows: <br /> <br />Item #7 - That the Applicants are requesting a variance to construct a <br />12' x 14' porch which will leave a rear yard of approximately 30 feet. <br /> <br />Item #8 - That the Applicants are requesting a variance of <br />approximately 5 feet from the required 35 foot rear yard setback. <br /> <br />Item #12 - That the Applicants have provided proof of a hardship on <br />Board of Adjustment/October 29, 1987 <br /> <br />Page 3 of 5 <br />
