<br />. <br /> <br />. <br /> <br />. <br /> <br />variances to Mr. Jeff Perowitz'" accessory structure for size and materials type <br />due to an error on the part of City Staff and to allow construction of the <br />structure to proceed to completion. <br /> <br />Motion failed. Voting Yes: Chairman Zimmerman, Commissioners Shumway and <br />LaDue. Voting No: Commissioners Deemer, Peterson and Hendriksen. Abstain: <br />Commissioner Howell. <br /> <br />Motion by Commissioner Deemer to grant variances to Mr. Jeff Perowitz'" <br />accessory structure for size and materials type contingent upon the contractor <br />or owner furnishing the City with a certificate of lot survey. <br /> <br />Motion failed for lack of a second. <br /> <br />Commissioner Peterson stated that he knows Mr. Perowitz applied for the <br />building permit in good faith, but he drives by the property every day and a <br />pole barn does not look good. Commissioner Peterson said he could go along <br />with granting a variance to building size if the appearance of the pole barn <br />were to be improved. <br /> <br />Commissioner Hendriksen agreed. <br /> <br />Mr. Perowitz presented a letter, signed by many of his neighbors (Attachment <br />I), which states that they do not have a problem with the appearance of the <br />pole barn and that they do not feel it degrades neighboring properties. <br /> <br />Commissioner LaDue stated that Mr. Perowitz' followed the City"'s instructions <br />and now the City should grant Mr. Perowitz the necessary variances and not <br />require Mr. Perowitz to spend any more money, not even for a certificate of lot <br />survey. <br /> <br />Commissioner Deemer noted that certificate of lot surveys are required with <br />every building permit application. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to grant <br />variances to Mr. Jeff Perowitz' accessory structure for size, external finish <br />and height contingent upon Mr. Perowitz providing the City with a certificate <br />of lot survey. <br /> <br />Motion carried. Voting Yes: <br />Peterson, LaDue and Hendriksen. <br />Commissioner Howell. <br /> <br />Chairman Zimmerman, Commissioners Deemer, <br />Voting No: Commissioner Shumway. Abstain: <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Deemer directing <br />that from this point on, City Staff will require a certificate of lot survey <br />with every application for a building permit. Further, that accessory building <br />construction and materials type will be the same as that of the principal <br />structure on R-1 lots of 2-1/2 acres or less. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, LaDue, <br />Shumway, Peterson, Hendriksen and Howell.
