<br />Mayor Heitman stated that he has more question he would like to ask. <br /> <br />. Councilmanber Cox replied that there is a motion on the floor. <br /> <br />Chairperson Schlueter stated that all questions should be answered and directed <br />Mayor Heitman to continue. <br /> <br />Mayor Heitman stated that there other properties in the vicinity of Mr. Nieder <br />with accessory buildings, one in p:lrticular is of the lX'le barn type 1 irq:uired <br />if these other property owners went through the proper City procedure for <br />oversized accessory buildings. <br /> <br />Ci ty Attorney Goodrich stated that if the property owners went through the <br />proper procedure there would be a cop.{ of their permit included in their <br />p:lrticular p:lrcel file. <br /> <br />Mayor Heitman il'XIuired as to how Council could derw Mr. Nieder' s r~uest, if <br />they chose to, if two of Mr. Nieder's neighbors were granted the same variance. <br /> <br />Councilmanber Cox restated his motion. <br /> <br />Motion ~ Councilmanber Cox and seconded ~ Councilmanber Sorteberg to adopt <br />Findings of Fact 0118, amended to state building size of 30' x 34', for Mr. <br />Peter Nieder's Board of Adjustment variance. (Please refer to findings of fact <br />file for Findings of Fact 0118). <br /> <br />'. <br /> <br />Motion carried. Voting Yes: <br />Sorteberg. Voting No: None. <br />Reimann. <br /> <br />Chairperson Schlueter, Councilmanbers Cox and <br />Abstain: Mayor Heitman. Absent: Councilmanber <br /> <br />Councilmanber Cox asked for an explanation of Mayor Heitman's vote to abstain. <br /> <br />Mayor Heitman stated that he has the prerogative to abstain. <br /> <br />Councilmanber Cox stated that Mayor Heitman should be accountable. <br /> <br />Mayor Heitman replied that he is not accountable to Councilmanber Cox. <br /> <br />Councilmanber Cox stated that the Mayor is accountable to the citizens. <br /> <br />Motion ~ Councilmanber Cox and seconded ~ Councilmanber Sorteberg to approve <br />Mr. Peter Nieder's request for a Board of Adjustment variance, contingent upon <br />Mr. Nieder's entering into a developnent agreement with the City of Ramsey. <br /> <br />Further Discussion: Chairperson Schlueter irq:uired as to Councilmanbers <br />Sorteberg's opinion in this case regarding placing buildings in a way that will <br />allow for future subdivision of the property. Mr. Nieder stated that his <br />frontage is 95' and there is no way his p:lrcel could ever be subdivided. <br />Chairperson irq:uired if Mr. Nieder is planning on accessing the accessory <br />building fran l62nd. Mr. Nieder stated that he currently has a second access <br />fran l62nd that he has been using for the last 10 years. <br /> <br />. <br /> <br />Voting Yes: Councilmanbers Sorteberg and Cox.
