<br />. <br /> <br />. <br /> <br />. <br /> <br />geogra};tlically, the ~ople in the ouUying areas will not receive suitable <br />radio stations. <br /> <br />COuncilmanber Schlueter iD;luired if EM ooncerns with increased tCMer height at <br />the present IrnVN location are based on the present Gateway airport layout or <br />that presented in the airport master plan. <br /> <br />Mr. Fries stated that EM's ooncerns are based on the airport layout plan <br />navigational fra:}uencies. <br /> <br />Mayor Heitman iD;luired if EM would approve the tCMer height increase if <br />Gateway were not expanded. <br /> <br />Mr. Fries replied that the new tCMer height would not be approved if Gateway <br />were not expanded; the present IrnVN facility was grandfathered in and EM would <br />prefer the present tCMer lowered in height. <br /> <br />Mayor Heitman stated that he detected a softness in tone when K'IWN was <br />questioned whether or not th~ intended to rent space on the tower to other <br />antennas. <br /> <br />Mr. Fries replied that renting space on the tCMer is not a major eoonomic <br />factor to K'lWN. Mr. Fries stated that he can see a situation where another <br />user would approach K'lWN for tCMer space; that tCMer is a support facility _ <br />not an antenna; often times cities prefer that tCMer space be rented to other <br />users rather than oonsidering building another tCMer in the city. IrnVN has no <br />objection to being restricted with respect to renting tower space. <br /> <br />Mr. Goodrich stated that a oondition of the variance oould be to restrict IrnVN <br />fran renting space on the tCMer. <br /> <br />Mayor Heitman iD;luired if such a restriction would not be imposing on K'lWN's <br />right to generate income. <br /> <br />Mr. Goodrich stated that if the City ooncludes that renting space on the tower <br />will adversely affect the health and welfare of the citizens, the City can <br />place restrictions on the variance. Mr. Goodrich noted that' health and <br />welfare' is not limited to physical health and welfare; it can include eoonomic <br />health and social well being. <br /> <br />COuncilmenber COx stated that the City's comprehensive plan spells out that <br />area enoouraged for conunercial and industrial developnent; there has also been <br />real concern expressed regarding property values and structure oollapse. <br />COuncilmanber COx stated that his intent is to amend the proposed findings of <br />fact to derw K'lWN's ra:}uest; also ra:}uested that roll call votes be called for <br />in this issue. <br /> <br />COuncil amended the proposed findings of fact as folICMS: <br /> <br />1.
