<br />. <br /> <br />of Mr. Michael Schafer's request to construct an accessory structure of 720 <br />square feet in his front yard based on input and correspondence received <br />from Mr. Schafer's neighbors and on the fact that the City Council does <br />not approve building permits for buildings to be constructed within the <br />front setback. <br /> <br />Further Discussion: City Attorney Goodrich stated that a petition, even <br />100%, opposing approving the request, is not sufficient grounds to deny; <br />denial should be based on the Findings of Fact in which the petition is <br />included. Council consensus is that the motion to deny Mr. Schafer's <br />request is based on the Findings of Fact. Mr. Schafer stated that his <br />property is not platted in a way that he can gain access to the rear of his <br />property. Councilrnernber Reimann stated that an accessory buidling <br />constructed wi thing the front setback is unacceptable. Mr. Schafer <br />requested that the property be viewed before a decision is made. <br />Cllairperson Schlueter stated that she has viewed the subject property and <br />the accessory building would be very visible. <br /> <br />Motion carried. Voting Yes: Cllairperson Schlueter, Mayor Garnec, <br />Councilrnebmers Sorteberg, Reimann and Van Wagner. Voting No: None. <br /> <br />. <br /> <br />Case #2: Request For Board of Adjustment Variance 'Ib Construct An <br />Accesso~y Building Larger than Allowed ~ Ci~ Ordinance: <br />Case of Mr. Jack Engel: <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilrnernber Sorteberg <br />to adopt Findings of Fact 0094 for the Board of Adjustment variance for Mr. <br />Jack Engel to construct a detached accessory building of 864 square feet. <br />(Please refer to findings of fact file for Findings of Fact 0094). <br /> <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Gamec, <br />Councilrnernbers Sorteberg, Reimann and Van Wagner. Voting No: None. <br /> <br />Cllairperson Schlueter stated that she has viewed the subject property, the <br />accessory building has already been constructed and she is opposed to the <br />request on the basis that Mr. Engel did not properly apply for permi ts <br />prior to construction. <br /> <br />Mr. Engel stated that he received verbal permission to construct the <br />building from Building Official Berg, he talked to a builder regarding <br />construction and when he returned from a trip to Montana he found that the <br />building had already been put up. <br /> <br />Chairperson Schlueter stated that in the agreement it is stated that the <br />accessory building will be compatible with the house structure; Mr. Engel <br />has put up a pole barn and the material in it is not compatible wi th that <br />of a house structure. <br /> <br />Mr. Engel stated that his property description says that his lot is one <br />acre but it is closer to 3 acres and that his neighbor has an even larger <br />pole barn on his 20 acres. <br /> <br />. <br /> <br />Mayor Gamec stated that there are no accessory building size restrictions <br />on 20 acre parcels. <br /> <br />Page 2 of 3 <br />
