<br />. <br /> <br />. <br /> <br />. <br /> <br />, ' <br />" <br /> <br />Ci~ Building Official Berg stated that a building permit has not been <br />issued to Mr. Engel: that he informed Mr. Engel that a variance is required <br />to build an accessory building larger than code allows for. <br /> <br />Mr. Engel repeated that when he returned from a trip to Montana, the <br />building was already constructed. <br /> <br />Ci ty Attorney Goodrich stated that the Council can either grant the <br />variance and charge double for the building permit fee or have the building <br />torn down. <br /> <br />City Building Official referred to Chairperson Schlueter's remarks <br />regarding the building being compatible with the house structure and stated <br />that in the past, Council has decided that 'compatible' will be color and <br />not materials used. <br /> <br />City Attorney Goodrich stated that Council must ignore the fact that the <br />building has already been constructed and make a decision regarding the <br />variance request as if the building was not there. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Reimann, <br />for further discussion, to approve of Mr. Jack Engel's request to construct <br />an accessory building of 864 square feet, contingent upon his entering into <br />a developnent agreement wi th the Ci ty. <br /> <br />Further Discussion: Councilmember Reimann stated that Mr. Engel has placed <br />Council in a bad position by constructing prior to following proper <br />procedures. Mr. Engel stated that he tries to abide by rules and added <br />that he still has an unf inished cul-de-sac that the Ci ty does not address. <br />Mr. Engel stated that he bought an over-the-road tractor and needs <br />somewhere to service it periodically: this and some storage are the only <br />intended uses for the pole barn. Councilmember Reimann stated that Mr. <br />Engel should approach the City regarding cul-de-sac problems. Mr. Engel <br />stated that he has approached the City 3 times. <br /> <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Gamec and <br />Councilmembers Sorteberg, Reimann and Van Wagner.
