<br />. <br /> <br />. <br /> <br />. <br /> <br />City Attorney Goodrich explained that the City might not have a legal <br />obligation, but it does have a moral obligation to protect the property <br />owners in the event of an emergency; access to the properties could be <br />hindered by a private road that is not kept clear. <br /> <br />Mr. Schaumberg, who is on the regular Council agenda, stated that he will <br />be requesting the City to waiver the blacktop requirement, upgrade to Class 5 <br />at the expense of the residents, until development occurs. <br /> <br />Chairperson Schlueter verified that this private road is well maintained. <br /> <br />Councilmember Reimann stated that allowing another dwelling to be builton <br />that private road is only going to add to the problems. <br /> <br />Mayor Gamec noted that a condition of the agreement is that no future <br />building permits be issued until the road is upgraded. <br /> <br />Councilmember Reimann reiterated that allowing another dwelling would be <br />adding to a problem that already exists; that he has not objection to <br />Mr. Kurak building there, but the City has the responsibility for the <br />safety of it's citizens. <br /> <br />:0ouncilm~ber.s6rteberg noted that nothing can be done to the road until <br />the property owners petition. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner <br />to approve of Mr. Thomas Kurak's request to place a second dwelling on a <br />60 acre parcel of land without frontage on a public street. <br /> <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Gamec, Council- <br />members Sorteberg: and.'.Van Wagner.
