That he did not have the <br />. letter with him. . . . . <br /> <br />Alb: I'm not ask1ng that quest1on, Mr. Cha1rman, I'm ask1ng of the letter that was <br />sent by Mr. Goodrich to the Attorney General stating the facts. <br /> <br />Gorham: Mr. Albert is referring to the letter that Mr. Goodrich sent to the Attorney <br />General's office so that he could render his opinion. Do you then say that that was not <br />read at that meeting? <br /> <br />Oliphant: It may have. I don't recall. I don't know the extent of the... . INTERRU PI' ION ... <br /> <br />Albert: I am asking this Board to make specific note of Subparagraph M especially the <br />last sentence where it is alleged that the pet~tioners are unaware of thelacts given <br />to the Attorney General's office which resUlted in the opinion. I am asking you to make <br />note that this statment was made under oath by the petitioners. <br /> <br />Oliphant: Unless we get the .Attorney General to talk to Mr. Goodrich - HA* INTERRUPTION.. <br /> <br />Albert: Nov.], I'm not talking about the .Attorney General's letter and neither is your <br />petition. <br /> <br />Gorham: Mr. Albert made the point that the letter sent by Mr. Goodrich to the Attorney <br />Genenalfs office was made a part of the Council Meeting of April lLt. <br /> <br />.Albert: Are you willing to stipulate that it was? <br /> <br />. Oliphant: No, Ifm not willing to stipulate to anything.' It was, it was.... <br /> <br />Albert: So does the oath taken by the petitioners speak for itself. <br /> <br />Oliphant: The petitioners are unaware of who the attorney General was. They are unaw'are <br />of the phone conversation that Mr. Goodrich alluded to at the meeting. We have no idea <br />if he sent one letter, two letters, three letters. We have no idea if he had telephone <br />conversations or a telegram or anything else. <br /> <br />Albert: Mr. Chairman, I think this is a very serious matter. This was a statement made <br />under oath by these petitioners on an action that Mr. Oliphant, he's representing these <br />petitioners, and what I said is that statement made under oath, is a false statment made <br />under oath because the statement was read aloud in the presence of the petitioners and <br />at the petitioners attorney at the meeting on April 14, 1975. That is what I am alleging. <br /> <br />Cox: I don't think that there is any question about that. <br /> <br />Goodrich: Mr. Chairman, the Board can take cognizant of vote to the matters which they <br />are discussing and take it into consideration. <br /> <br />Oliphant: May I go on to our next point? <br /> <br />Gorham: I think that it should be made a point of record of this Board of Adjustment that <br />in the event of the Council Meeting held on .April 14 should become a p2rt of this meeting. <br /> <br />Oliphant: r've already asked that. <br /> <br /> <br />. Gorham: It does reflect that in those minutes that matter. <br /> <br />Sure. <br /> <br />Gorham: Mr. Gorham said that he pointed out at the last meeting that he did not have a <br />
