That the petition to rezone the above parcel of land was filed <br /> <br />by Alfred A. Albert, President, Royal Esquire Realty, Inc., 366 Jackson <br /> <br />Street, st. Paul, Minnesota 55101, on or about November 13, 1974, and <br /> <br />that at the time of the filing the petitioners were listed as Stephen <br /> <br />W. and Gloria J. Holasek and Martin H. and Irene Gorham. <br /> <br />C. That the petitioners in this action are currently residents of <br /> <br />the city of Ramsey and were so during the entire period during which <br /> <br />this matter was before the Ramsey City Council. <br /> <br />II. <br /> <br />Petitioners allege that the action taken by the Ramsey City Council <br /> <br />resulting in final approval was illegal in that such action was contrary <br /> <br />to Local Ramsey Ordinance 73-5, Section 8.5(E). <br /> <br />A. A public hearing was held on January 29, 1975, by the Ramsey <br /> <br />City Council pursuant to Ramsey City Zoning 73-5, Section 8.5. <br /> <br />B. That on February 11, 1975, the City Council at the request <br /> <br />of the developer continued the matter for decision. <br /> <br />C. That on March 24, 1975, fifty-four (54) days after the last <br /> <br />public hearing, the council acted on the matter and defeated the <br /> <br />petition by a vote of three in favor, one against, and one abstention. <br /> <br />State Statute 462.357, Subd. 2, permits a governing body to amend a <br /> <br />zoning ordinance by a two-thirds vote of all its members. <br />
