That the action taken March 24, 1975, was illegal because <br /> <br />Ramsey Ordinance 73-5(E) requires action on a petition within 45 <br /> <br />days of the public hearing and makes no provision permitting an <br /> <br />extension of time. <br /> <br /> <br />E. That on April 14, 1975, the council again illegally acted on <br /> <br /> <br />the petition to rezone, such action occurring seventy-four (74) days <br /> <br /> <br />after the last public hearing on the matter, and approved the rezoning <br /> <br />by a 4-1 vote, such action being clearly illegal for the reason set <br /> <br />forth in paragraph JJ:(d) above. <br /> <br />III <br />The action by the City Council adversely affects the health, <br /> <br />safety and welfare of the children of the city of Ramsey in that: <br /> <br />A. The property involved in this action was described by the <br /> <br />developer as property to be developed into a regional and commercial <br /> <br />shopping center attracting residents of Andover, Anoka, and st. <br /> <br />Francis--that it would be the possible hub for all commercial activity <br /> <br />north of Anoka. <br /> <br />B. That located across from the rezoned property on about 50 <br /> <br />acres of land at 1500 Nowthen Boulevard is Ramsey Elementary School <br /> <br />which has a student population of about 851 students. <br /> <br />C. That Ramsey Elementary School and the new commercial center <br /> <br />are separated by County and State Aid Highway No.5. <br /> <br />D. That evidence was given to the City Council in letter form <br /> <br />by the Superintendent of Schools that establishing commercial use <br /> <br /> <br />land in the vicinity of various schools in the school district had <br /> <br /> <br />created serious hazards to the children attending the schools. <br /> <br /> <br />E. That despite the suggestion to the Council that a traffic <br /> <br />study be carried out or the offer by the school district to provide <br /> <br />information on the subject, the Council failed to conduct a traffic <br /> <br />study and failed to obtain other relevant information on the subject <br /> <br />from the District 11 School Board. <br />
