WHAT'S HAPPENING
AT CITY HALL

The City Council met on September 21 and con-
ducted a public hearing regarding the proposed
1990 budget. Council then proceeded to review the
proposed capital outlay, staffing plans, and projected
revenues and trust fund balances for 1990. Council
lots within the Northfork Planned Unit Development);
Nature View Addition (19 lots located west of
Nowthen Blvd., north of Highpoint Addition); Becker
Rolling Pines Addition (the subdivision of 19 acres
into two lots located south of Pine Cove). Council
approved Robert Wojcik's request for a conditional
to eliminate the requirement that all off-sale liquor
stores be located within the City's urban area. An
ordinance was adopted setting the fees for water and
sewer utilities. Current City ordinance requires that
properties hook-up to municipal services within two
years of sewer becoming available; on October 10,
Council adopted an ordinance amending provisions
of the Water and Sewer Chapter to define when
municipal sewer is determined to be available. Coun-
cil discussed traffic and pedestrian safety concerns
ed the findings of fact and issued a negative declara-
tion for need of an environmental impact statement
on the extension of 153rd Avenue. City Staff was
directed to forward a proposed ordinance regarding
Solid Waste Landfills to Metro Council for review and
input. City Staff was also directed to solicit proposals
from firms that can provide the technical expertise
to evaluate the Environmental Impact Statement
relating to the landfill siting process and from lob-
byists to represent Ramsey with regards to propos-
ed legislation regarding landfill siting. Council
adopted an ordinance to regulate the burning of cer-
tain waste types by use of incinerators. An ordinance
was adopted to set fees for water and sewer utilities.
COUNCIL ADOPTS ORDINANCE

TO AMEND PROVISIONS OF

THE WATER AND SEWER

UTILITIES CHAPTER

On July 13, 1989, Metropolitan Council approved
the City's request for expansion of the MUSA area.
As a condition of approval, the City agreed to amend
certain provisions of it's City Code pertaining to
sewer connections. Chapter 210.2, Section 1, of the
City Code currently requires connection to services
within two years of sewer becoming available. On
October 10, City Council adopted the following or-
dinance amendment to define when municipal sewer
is determined to be available in accordance with
Metro Council and Metropolitan Waste Control Com-
mission definitions:

The owner of all dwellings, buildings, other struc-
tures or properties where cesspools or septic tanks
have been in existence prior to construction of a
sanitary sewer shall connect with the public sanitary
sewer when such cesspools and septic tanks are in
need of repair, reconstruction or pumping, or within
two (2) years of the date that municipal sanitary
sewer service is available to the premises, whichever
is first to occur. Municipal sanitary sewer service
shall be determined to be available to the
premises when trunk or lateral sewer occupies
the right-of-way or easement adjacent to or on
the property. In the event that the City Council
finds that hookup to municipal sewer is not feasible
due to distance, topography, physical barrier or
pending land use change; sewer connection shall
not be required until such condition changes thereby
allowing for feasible connection.
COUNCIL ADOPTS ORDINANCE

TO REGULATE CONTRACT

BURN FACILITIES IN THE CITY

On October 10, the Ramsey City Council adopted
the following ordinance to regulate the burning of
certain waste types by the use of incinerators in
Ramsey:

170.015K INCINERATION BURNING

a. Notwithstanding anything to the contrary in
Chapter 170.01 of the City Code, no burning of
solid waste, hazardous waste, medical waste or
special waste by use of an incinerator or hazar-
dous waste incinerator shall be allowed within the
City either as a permitted use or conditional use.

b. As used herein the following words shall have the
meanings defined herein:

"Hazardous Waste" means any refuse, sludge,
or other waste material or combinations of refuse,
sludge or other waste materials in solid, semisolid,
liquid, or contained gaseous form which because
of its quantity, concentration, or chemical,
physical, or infectious characteristics may (a)
cause or significantly contribute to an increase in
mortality or an increase in serious irreversible, or
incapacitating reversible illness; or (b) pose a
substantial present or potential hazard to human
health or the environment when improperly
treated, stored, transported, or disposed of, or
otherwise managed. Categories of hazardous
waste materials include, but are not limited to: ex-
plosives, flammables, oxidizers, poisons, irritants,
and corrosives. Hazardous waste does not in-
clude source, special nuclear, or by-product
materials as defined by the Atomic Energy Act of
1954, as amended.

"Hazardous Waste Incinerator" means an
enclosed device using controlled flame combus-
tion, a purpose of which is to thermally break
down hazardous waste and that neither meets the
criteria for classification as a boiler nor is listed
or can be classified as an industrial boiler.

"Incinerator" means any furnace or other device
used in the process of burning solid waste, hazar-
dous waste, medical waste or special waste for
the purpose of reducing the volume of the waste
by removing combustible materials.

"Medical Waste" means all segregated, non-
recycled wastes other than kitchen or office
wastes produced by hospitals, clinics, doctors'
and dentists' offices, funeral homes, veterinary
clinics, and other medical and research facilities.
These wastes include infectious wastes as defin-
ed by part 7035.0300, subpart 48 of Minnesota
Rules, or other relevant rule or statute defining
infectious wastes, pathological waste, and
laboratory wastes.

"Solid Waste" means garbage, refuse, and other
discarded solid materials, except animal w'aste
used as fertilizer, including solid waste materials
resulting from industrial, commercial, and
agricultural operations, and from community ac-
tivities. Solid waste does not include earthen fill,
boulders, rock, and other materials normally
handled in construction operations, solids or
dissolved material in domestic sewage, or other
significant pollutants in water resources, such as
silt, dissolved or suspended solids in industrial
waste water effluents, dissolved materials in ir-
rigation return flows, or other common water
pollutants.

"Special Waste" means any waste material not
considered hazardous or solid waste which has
been determined by the Minnesota Pollution Con-
trol Agency or Environmental Protection Agency
to require special handling or treatment prior to
disposal.

c. Nothing contained herein shall prohibit the use
of incinerator burning of solid waste as defined
herein generated on the premises by incinerators
lawfully permitted and presently in use within the
City.

This ordinance will become effective November 13,
1989.
