Councilmember Zimmerman inquired if it would be possible to include the Chapter 7080 <br />language in the ordinance rather than just referencing it. <br /> <br />Community Development. Director Frolik explained that the 7080 language is included in <br />Chapter 8 of City Code, so it would be better to reference the appropriate section in Chapter 8. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Elvig, to introduce an ordinance <br />amending Section 9.50 of the City Code as amended by the City Council. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #8: Report from the Public Works Committee <br /> <br />1) <br /> <br />Consider Extension of C.R. #116 Median East of T.H. #47 <br />The Public Works Committee recommended that the C.R. #116 median be extended and <br />that a left turn lane along T.H. #47 be constructed to Blue Velvet Lane and that a right <br />turn lane into the gas station along C.R. #116 be constructed and a right-in, right-out <br />access into River's Bend Plaza on the south access. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Cook, to recommend to <br />Anoka County that the C.R. #116 median be extended and that a left turn lane along T.H. #47 be <br />constructed to Blue Velvet Lane and that a right turn lane into the gas station along C.R. #116 be <br />constructed and a right-in, right-out access into River's Bend Plaza on the south access. <br /> <br />Further discussion: Councilmember Kurak inquired if Blue Velvet could close their frontage to <br />Blue Velvet Lane if they wanted to since it is a private road. City Administrator Norman noted <br />that the City does have the right to eminent domain, but explained that Blue Velvet has indicated <br />that they would like the City to take over Blue Velvet Lane. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Zimmerman, Cook, Elvig, <br />Kurak, Pearson, and Strommen. Voting No: None. <br /> <br />Councilmember Kurak inquired of the City Attorney if the City were to construct an access from <br />T.H. #47 to Blue Velvet Lane, would there be a problem since Blue Velvet Lane is a private <br />road. <br /> <br />City Attorney Goodrich replied that the City would have to acquire the property. <br /> <br />Mayor Gamec noted that the City does own the front portion of the easement so they would be <br />technically opening up an access to a private road. <br /> <br />City Administrator Norman noted that the last time the issue was discussed, the owner of Blue <br />Velvet was willing to give the road to the City. <br /> <br />City Council/April 8, 2003 <br />Page 12 of 17 <br /> <br /> <br />
