<br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-10-291 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0777 RELATING TO A REQUEST <br />FOR A VARIANCE TO REAR YARD SETBACK REQUIREMENTS <br /> <br />WHEREAS, GMI Inc., hereinafter referred to as "Applicant," has properly applied for a <br />variance from Section 9.20.24 of the Ramsey City Code to construct an addition to the existing <br />building that will encroach on the rear yard setback on the property generally known as 6511 <br />Bunker Lake Blvd and legally described as follows: <br /> <br />Lot 1, Block 1, Gateway North Industrial Park Plat 4, Anoka County, Minnesota <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on October 5, 2006, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />1. That the subject property is zoned E-I Employment District and is approximately 2.3 <br />acres in size. <br /> <br />2. That the subject property is surrounded by E-I Employment District zoning developed <br />with businesses. <br /> <br />3. That section 9.20.24 (E-I Employment District) requires a thirty~five (35) foot rear yard <br />setback. <br /> <br />4. That the applicant is proposing to enlarge an existing building that will have an <br />encroachment of 15 feet on the rear yard setback on the north side of the lot. <br /> <br />5. That the lot is irregularly shaped, with a short depth and large amount of frontage on <br />Bunker Lake Blvd (a County Road). <br /> <br />6. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />7. That the proposed addition meets all other setback requirements. <br /> <br />8. That if granted, the variance will not permit a use that is prohibited in the E-I <br />Employment District. <br /> <br />9. That if granted, the variance will not impair an adequate supply of light and air to <br />adj acent property. <br />
