<br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />~SOLUTION #06-12-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br />YARD SETBACK FOR CERTAIN PARCELS IN THE PLAT OF BROOKFIELD <br />ADDITION, AND DECLARING TERMS OF SAME. <br /> <br />wHEREAS, Oakwood Development, Inc. (permittee), has properly applied for a <br />variance from the front yard setback from public street requirement in the R-1 Residential <br />District on the property generally located south of Trott Brook, west of Nowthen Blvd, and east <br />ofVariolite Street and legally described as follows: <br /> <br />Lots 7-16 and 19-22, Block 3, and Lots 14-16, Block 1, Brookfield 1st Addition, <br />Anoka County, Minnesota <br /> <br />And <br /> <br />Lots 19-50, Block 3, as shown on the approved preliminary plat of Brookfield, <br />prepared by Passe Engineering and dated August 26, 2005 <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on December 7, 2006, conducted the public <br />hearing and adopted fIndings of fact relating to the request for a variance from the front yard <br />setback requirements on the Subject Property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />1. Based on Findings of Fact #_, a five (5) foot variance to the thirty (30) foot front yard <br />setback requirement, as established in Section 9.20.11 of the Ramsey City Code, is <br />hereby granted for the following parcels: Lots 7-16 and 19-22, Block 3, and Lots 14-16, <br />Block 1, Brookfield 15t Addition; and Lots 19-50, Block 3, as shown on the approved <br />preliminary plat of Brookfield, prepared by Passe Engineering and dated August 26, <br />2005. <br /> <br />2. All ofthe dwellings constructed on the parcels identifIed in Item #1 ofthis Variance shall <br />maintain a twenty-fIve (25) foot setback from the public road right-of-way. <br /> <br />3. No construction shall commence until the approved fInal plat has been recorded and the <br />issuance of a building permit. <br /> <br />4. This Variance will not become null and void within twelve (12) months of the date of <br />approval so long as the remainder of the plat is developed in accordance with the <br /> <br />7 <br />
