Mr. Bertolas replied one of the major issues is that any time the children go outside they cannot go into the parking lot; they cannot exit anywhere other than to a secured fenced-in structure. Mayor Gamec noted the permit has been denied by the Planning Commission. People from businesses in the area have asked about getting a daycare closer, and it seems logical with all the employment in this area. There is quite a bit of traffic in this area, but most daycares are located on major thoroughfares and highways. Councilmember Strommen stated she agrees essentially to having a daycare in an employment area, but with the land use surrounding this facility they would be setting the City up for conflicts such as parents complaining about the truck traffic and the asphalt plant. She does not want to set the City up for more problems because they allow a use that should not be allowed in this area in the first place. She agrees with the recommendation of the Planning Commission. Councilmember Olson expressed concern about dropping off children considering the heavy truck traffic in this area. She agrees with Councilmember Strommen that the fumes and the surrounding use in this area really are not conducive to a daycare. She agrees with the recommendation of the Planning Commission. Motion by Councilmember Strommen, seconded by Councilmember Olson, to adopt Resolution #06-10-322 to adopt Findings of Fact #0780 relating to a request for an Interim Use Permit to operate a daycare facility on the ground floor of the existing property at 6575 141 st Ave NW. Motion carried. V oting Yes: Mayor Gamec, Councilmembers Strommen, Olson, Cook, Elvig, Jeffrey, and Pearson. Voting No: None. Further discussion: Councilmember Elvig stated he is not in disagreement with having a daycare in this region; having the kids close to where mom and dad work is a nice thing. He has an issue with this location and the trafficking. He concurs with Councilmember Strommen's comments regarding the negative feedback if this use is allowed. The fumes are one of the problems in this area, and kids are more susceptive to the effects. There may be a more applicable spot for a daycare, but this does not appear to be the right location. Councilmember Jeffrey concurred. Mayor Gamec commented he believes there is a daycare a short distance from here. Councilmember Elvig indicated someone could put in a daycare across the street in residential area, but the City would be involved with the liability if they were to allow a daycare in this location.
