Metropolitan Council Meeting of March 28, 2001 <br />It was moved by Williams, seconded by J. Smith: <br />"That this meeting be closed to the public to discuss with legal counsel attorney- client <br />privileged matters and litigation issues related to the Metropolitan Council v. Lake and <br />Hennepin Associates L.L.P. , et al." <br />The chair explained that the Council must conclude in a public meeting that there is a legitimate need for <br />the Council to discuss the Metropolitan Council v. Lake and Hennepin Associates L.L.P. , et al. matter <br />with the Council's attorneys in a confidential setting. Possible reasons to close this meeting include: <br />1. Public discussion of litigation strategies and issues might compromise the Council's ability to obtain an <br />acceptable resolution of the claims asserted against the Council and may promote continued and costly <br />litigation. <br />2. Public discussion of any potential settlement and alternatives to settlement might compromise the <br />Council's ability to participate in settlement discussions or fashion a settlement on terms that are in the <br />public interest. <br />3. Public discussion of the Council's defenses to the claims asserted against the Council may jeopardize <br />the Council's ability to effectively litigate those claims or jeopardize the Council's ability to resolve this <br />matter on terms that are in the public interest. <br />4. Public discussion of the Metropolitan Council v. Lake and Hennepin Associates L.L.P. , et al. matter at <br />this time might inhibit frank discussion about the merits of the case and potential settlement issues. <br />It was noted that discussion at a meeting closed for purposes of seeking legal advice concerning litigation <br />issues must be confined to issues specifically related to the litigation, litigation strategy, and settlement. <br />The discussion at a meeting closed to the public cannot include general legal advice or issues not related <br />to the litigation. <br />A vote was then taken on the motion and carried. The meeting was closed at 4:05 p.m. The chair <br />directed all persons to leave the meeting room except Council members, the attorneys representing the <br />Council and those persons who needed to be involved in the meeting for purposes of discussing the <br />litigation. Following discussions in the closed portion of the meeting, it was moved, seconded and carried <br />to reopen the meeting at 5:05 p.m. <br />It was moved by Riveness, seconded by Steffen: <br />"That the Metropolitan Council approve Resolution No. 2001 -8 authorizing the acquisition <br />of fee title, Uptown Transit Hub, Project 63652." <br />Motion carried. <br />Reports <br />Chair <br />Chair Mondale congratulated Council Member Steffen on her work with the City of Ramsey that resulted <br />in the approval of their plan today. <br />6 <br />
