Voting No: None. <br /> <br />Case #2: <br /> <br />Adopt Ordinance to Rezone Property from B-1 Business to R-3 Urban <br />Residential; Case of Eighty Seven LLC <br /> <br />Community Development Director Frolik stated that on December 11, 2001, the City Council <br />adopted findings of fact and introduced an ordinance to rezone Outlot A, Brandseth, from B-1 <br />Business to R-3 Urban Residential. The rezoning would allow development of the property with <br />town homes at a density not to exceed seven units per acre. It was also noted that the City had <br />received a letter from the Met Council dated January 22, 2002, approving the Citis <br />Comprehensive Plan. - ~ <br /> <br />----- <br /> <br />.-_..-"- <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Ordinance #02-001 to <br />rezone Outlot A, Brandseth, from B-1 Business to R-3 Urban Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />. <br /> <br />Coul1cilmember Zimmennan aye <br />Councilmember Kurak aye <br />Coul1cilmember Anderson aye <br />Councilmember Hendriksen aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #3: <br /> <br />Adopt Ordinance to Rezone Certain Property from R-l Rural Residential to <br />R-l Urban Residential; Case of Oakwood Land Development, Inc. <br /> <br />Community Development Director Frolik stated that on December 11, 2001, the City Council <br />adopted .findings of fact and introduced an ordinance to rezone property in Section 14 from R-l <br />Rural Residential to R-l Urban Residential. The property also received sketch plan approval and <br />was proposed to be platted as River Pines 5th Addition with 17 new single family lots and one <br />existing homestead. <br /> <br />Councilmember Anderson noted that #10 in Resolution #01-12-424 should read "will not". <br /> <br />City Attorney Goodrich noted that a motion should be made to amend paragraph #10 to read that <br />the proposed zoning amendment will not adversely impair the use or market value of any <br />surrounding property. <br /> <br />CounciImember Hendriksen inquired if that was necessary since all of the findings do not have to <br />. be in the positive. <br /> <br />City Council/January 22, 2002 <br />Page 9 of 25 <br />
