3.3 "Gifu Council" means the city council of the City of Ramsey. Minnesota <br />3.4 "Gifu Public Improvements" means the improvements Section 12 of this <br />Agreement obligates City to construct on the Development Property. <br />3_5 "Closing Date" means Julv 15 2006 <br />3.6 "CR 116 Improvements" means the acquisition of right of way for and <br />the construction of the street- sanitary sewer water and storm sewer improvements <br />described in Bolton Menk Ines Preliminary Engineer's Estimate for Bunker Lake <br />Boulevard and Sunwood Drive (BMI No C12 36831) dated 12/11/061ast revised <br />"Developer" means RCM-Minnesota Corporation. a Minnesota <br />corporation. <br />3.8 "Developer Public Improvements" means the improvements Section <br />of this Agreement obligates Developer to construct on the Development Property <br />and dedicate or convey to the City <br />3.9 "Developer Private Improvements" means the improvements Section <br />of this Agreement obligates Developer to construct on the Development Property <br />and that Developer will not dedicate or convey to the Citv <br />3.10 "Development Property" means the real property legally described in the <br />attached Exhibit A. <br />3.11 "Effective Date" is the date set forth in Section 1 of this Agreement <br />3.12 "Environmental Remediation and Remediation Documentation <br />Activities" means the remediation and the remediation documentation activities the <br />City is obligated to undertake pursuant to Section of this Agreement <br />3.13 "Final Plat" -means a Final Plat. as defined in Section 9 50 Ol Subd 2 of <br />the Zoning and Subdivision Ordinance of the Development Property that is based on <br />the Preliminary Plat <br />3.14 "Final Plat Data" means the data and other information Developer is <br />required to submit to Citv pursuant to Section 9 50.02 Subd 6 of the Zoning and <br />Subdivision Ordinance as a condition of City's approval of the Final Plat <br />3.15 "Issuer" means the bank or other fmancial institution reasonably <br />cceptable to the Citv. that issues a Letter of Credit required by Section 12 3 or any <br />other Section of this Agreement <br />3.16 "Master Plan" means the lap for the development of the Development <br />Property that Section 9.20.28.
