Motion carried. Voting Yes: Mayor Ga.rnec, Councilme;mbers Olson, Jeffrey, Cook, Elvig,
Pearson, and Strommen. Voting No: None.

Case #2:

Request for Conditional UsePermit<forBob Hamborg to Exceed Maximum
Amount of Accessory Buildhtg ~paqe; Case of Bob Hamborg

Community Development Director Trudgeom indica~ed Bob Hamborg has submitted a blue print
for the construction of a 1,400 square foot accessory; structute on the property at 15755 Traprock
Street NW. Construction of this size of structure\on th~ property will cause an overage of
allowed garage and accessory structure spac~. The appliqant has submitted a conditional use
permit application in order to construct the accessory structure at the size proposed. Mr.
Trudgeon explained the subject property is 4.33 acres. City Code allows a maximum total
square footage for accessory buildings of 2,900 square feeton a lot of this size. If the proposed
accessory structure is constructed at the si~e curr~pt1y indicated on the blue prints, it would
create 3,760 square feet of accessory buildings. This equates to an overage of 860 square feet.
The subject property currently has one attache~ gara$~ at approximately 1,160 square feet and an
existing accessory building at approximat~ly. 1,200 square feet. . There are no driveways
proposed for either the existing accessory building or the proposed accessory building. The
applicant has expressed the need for additional indoor storage space in order to store the large
amount of items currently stored outdoors. .

Mr. Trudgeon noted that the maximum accCllssory structure allotments were recently increased,
most significantly on .5 to 2.5 acre parcels. The allotment increase for lots ranging from 1.5 to
2.5 acres in size was 536 square feet. The reason th~t these parcel size categories were amended
is because they represent the range for whic~ most applications for overages were received each
year. In the case of 4 acre parcels, there ",as an increase of 36 square feet made to the total
allotment, which was basically a rounding up. I( the recent amendment to City Code had
followed through with a 500 square foot increase (m addition to the 36 square foot round up) to
all remaining parcel size categories exceeding 2.5 a~;res, then a 4-acre parcel would be allowed
3,400 square feet. On that basis, staff had .recommenqed approval of a permit for an overage
limit of 500 square feet rather than the 860 square feet req~ested. It is noted that there is a fair
amount of tree screening on the nearest property line to the proposed building.

Mr. Trudgeon indicated the Planning Commission m~t on November 2 and held a public hearing.
There was one neighbor present whose accessoryl1?uilding encroaches onto Mr. Hamborg's
property. It was determined that the encroachment cannot be resolved with the requested
conditional use permit and requires sepat.;fite. action between the.. property owners. After
substantial discussion, the Planning Commission r~commended approval for the full amount
requested, 860 square feet. The recommendation was based on the opinion that an 860 square
foot overage is not unreasonable on a four .plus fcre parcel. In addition, the Commission
supports indoor storage of personal equipmeJ1tand vehicles. .

Motion by Councilmember Cook, seconded by CounFilmemberJeffrey, to adopt Resolution #06-
11-345 adopting Findings of Fact #0783 relating to request for a conditional use permit to

City Council / NoveI1lber14~ 2006
Pag~ 7 of ~1

P15
