K & K Sharp needs to have a little bit of sensitivity that cars <br />cannot be moved on a dime, and Midwest Car Care can have their 25 cars in a secured fence <br />area. Both parties should be able to work with this. He would like a little threat regarding the <br />decision that will be made by the Council if the parties cannot work the issue out. <br />Councilmember Elvig commented the agreement with K & K Sharp is only for one year, but <br />needs to be abided by. However, he does not remember including outdoor storage in that <br />agreement; the City leased the building. A reasonable compromise should be understandable to <br />the parties. <br />Mr. Fisher noted if the compromise of moving the fence is agreed to there will be a question <br />regarding who will pay for the cost. In the past both tenants have indicated they would not <br />entertain that cost. <br />Ms. Sharp stated she is here on behalf of K & K Sharp, and they do not want to lose the lease; <br />they want to be accommodating. Mr. Sharp had told her that he informed someone he would <br />look at the pricing on the fencing. He is willing to be flexible to make this lease work. <br />City Administrator Norman indicated the fencing could be charged to RALF. <br />City Attorney Goodrich suggested a cost not to exceed $5,000 for the fencing. <br />Councilmember Jeffrey indicated Mr. Fisher should be empowered to bring these parties <br />together with an agreement. <br />Consensus of the Council was to empower Mr. Fischer to bring K & K Sharp and Midwest Car <br />Care together with an agreement, and if that agreement includes fencing it should be charged to <br />Ralf in an amount not to exceed $5,000. <br />Mr. Fisher questioned if there is a stick behind the need for the parties to reach a compromise. <br />Mayor Gamec replied an agreement will be needed between the two parties by the next meeting <br />or Council will need to take action. <br />Councilmember Elvig indicated it should be noted that the Council is willing to choose one <br />tenant versus another if the issue is not resolved by the next City Council meeting. <br />Case #10: Facility Use and Facility Rental Policy <br />Management Intern Gladhill stated staff has prepared an amended Facility Rental Policy for <br />organizations seeking to rent meeting spaces in the new Municipal Center. The policy lists <br />procedures for renting space, priority of use, fees, hours, and general facility use rules. Staff has <br />also prepared a General Facility Use Policy for internal use. This policy provides guidelines for <br />building use for staff. Staff recommends Council adopt the resolution approving the amended <br />Facility Rental Policy and General Facility Use Policy. <br />City Council / November 14, 2006 <br />Page 17 of 31 <br />
