<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-09-308 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0778 RELATED TO RON <br />TALLMAN'S REQUEST FOR AN EXCEPTION TO THE DEVELOPMENT <br />MORATORIUM IN THE R-l RESIDENTIAL: RURAL DEVELOPING DISTRICT <br /> <br />FINDINGS OF FACT: <br /> <br />1. That the City adopted a development moratorium on the R-l Residential: Rural <br />Developing District pursuant to Ordinance #06-07 ("the Moratorium Ordinance"). <br /> <br />2. That Section 5 of Ordinance #06-07 permits Undue Hardship Exceptions to the <br />Moratorium under certain conditions. <br /> <br />3. That Ron Tallman ("the Petitioner") has applied for subdivision approval of a plat to be <br />known as Wild Oaks of Ramsey ("the Plat") on the following legally described property: <br /> <br />The west half of the Northwest Quarter of the Northeast Quarter of Section <br />8, Township 32, Range 25, according to the U.S. Government Survey, <br />Anoka County, Minnesota. <br /> <br />And <br /> <br />The north 447.60 feet of the east 526.00 feet, as measured along the east and <br />north lines, respectively, of the Northeast Quarter of the Northwest Quarter <br />of Section 8, Township 32, Range 25, according to the U.S. Government <br />Survey, Anoka County, Minnesota. <br /> <br />And <br /> <br />That part of the east 542.00 feet, as measured parallel with the north line of <br />said Northeast Quarter of the Northwest Quarter, lying south of the north <br />447.60 feet, as measured along the east line of said Northeast Quarter of the <br />Northwest Quarter, Section 8, township 32, Range 25, according to the U.S. <br />Government Survey, Anoka County, Minnesota. (the "Subject Property") <br /> <br />4. That the Petitioner has not received preliminary plat approval of the Plat for the Subject <br />Property . <br /> <br />5. That except for the temporary term of the Moratorium Ordinance, there are no special <br />circumstances or conditions affecting the Subject Property such that strict compliance <br />with the Moratorium Ordinance would deprive the Petitioner of reasonable use of the <br />Subject Property. <br />
