6. That except for its temporary term, the Moratorium Ordinance does not deny the Petitioner any substantial property rights. 7. Petitioner's property rights are not impacted by the moratorium except for the temporary term of the Moratorium Ordinance. 8. That approval of an exception to the Moratorium Ordinance will be in conflict with the intent of said Ordinance, because the purpose of the moratorium is to provide time for the City to amend deficient performance standards contained in the City's R-l Residential: Rural Developing district. 9. That approval of an exception to the Moratorium Ordinance will be injurious to other property in the area by allowing a proposed subdivision to proceed under inadequate performance standards which will be amended prior to the expiration of the Moratorium Ordinance. Inadequate performance standards include but are not limited to density transitioning requirements, lot sizes, open space requirements, and requirements related to community septic systems. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Strommen, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Elvig Councilmember Strommen Councilmember Jeffrey and the following voted against the same: Councilmember Cook Councilmember Olson Councilmember Pearson and the following abstained: None and the following were absent: None whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the 26th day of September 2006. ~~~ Mayo Resolution #06-09-308 Page 2 of3
