<br />6. That except for its temporary term, the Moratorium Ordinance does not deny the <br />Petitioner any substantial property rights. <br /> <br />7. Petitioner's property rights are not impacted by the moratorium except for the temporary <br />term of the Moratorium Ordinance. <br /> <br />8. That approval of an exception to the Moratorium Ordinance will be in conflict with the <br />intent of said Ordinance, because the purpose of the moratorium is to provide time for the <br />City to amend deficient performance standards contained in the City's R-l Residential: <br />Rural Developing district. <br /> <br />9. That approval of an exception to the Moratorium Ordinance will be injurious to other <br />property in the area by allowing a proposed subdivision to proceed under inadequate <br />performance standards which will be amended prior to the expiration of the Moratorium <br />Ordinance. Inadequate performance standards include but are not limited to density <br />transitioning requirements, lot sizes, open space requirements, and requirements related <br />to community septic systems. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Strommen, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Elvig <br />Councilmember Strommen <br />Councilmember Jeffrey <br /> <br />and the following voted against the same: <br /> <br />Councilmember Cook <br />Councilmember Olson <br />Councilmember Pearson <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 26th day of September 2006. <br /> <br />~~~ <br />Mayo <br /> <br />Resolution #06-09-308 <br />Page 2 of3 <br />
