<br />"# <br /> <br />10. That in accordance with City Code, the proposed building will be constructed of materials <br />similar to that of the home. <br /> <br />11. That the proposed accessory building will meet or exceed all applicable setbacks. <br /> <br />12. That the Applicants have obtained the signatures of six (6) surrounding property owners <br />supporting this request. <br /> <br />13. That the variance requested is not the minimum variance which would alleviate the hardship <br />in regard to the sidewall height of the structure. <br /> <br />14. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />15. That if granted, the variance will not have the effect of allowing a use that is prohibited in the <br />applicable zoning district. <br /> <br />16. That if granted, the variance will not impair established property values within the <br />neighborhood. <br /> <br />17. That the increased height will be compatible with the principal building on the same parcel. <br /> <br />18. That the increased height will be compatible with existing development in the immediate <br />neighborhood. <br /> <br />19. That if granted, the variance will not unreasonably increase the congestion in the public <br />street. <br /> <br />20. That if granted, the variance will not increase the danger of fire or endanger the public safety. <br /> <br />21. That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />22. That, if granted, the variance will not grant the Applicant any special privileges that are <br />denied to other owners of land in the same district. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Trites Rolle, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Trites Rolle <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Levine <br />Board Member Van Scoy <br /> <br />RESOLUTION #06-11-340 <br />Page 2 of3 <br />
