<br />Acting Chairperson Van Scoy introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-12-369 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0784 RELATING TO A <br />REQUEST FOR A VARIANCE FROM FRONT YARD SETBACK REQUIREMENTS IN <br />THE R-l RESIDENTIAL DISTRICT <br /> <br />WHEREAS, Oakwood Land Development, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Board of Adjustment variance to the front yard setback requirement <br />established in Section 9.20.11 (R-1 Residential District) of the Ramsey City Code on the property <br />generally located south of Trott Brook, west of Nowthen Boulevard, and east of Variolite Street <br />and legally described as follows: <br /> <br />Lots 7-16 and 19-22, Block 3, and Lots 14-16, Block 1, Brookfield 1st Addition, <br />Anoka County, Minnesota <br /> <br />And <br /> <br />Lots 19-50, Block 3, as shown on the approved preliminary plat of Brookfield, <br />prepared by Passe Engineering and dated August 26, 2005 <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on December 7,2006, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That Section 9.20.11 (R-l Residential District), Subd. 4 (Bulk Standards), Metropolitan <br />Urban Service Area (MUSA), establishes a front yard setback of thirty (30) feet from the <br />right-of-way of public roads. <br /> <br />3. That the following parcels in the plat are requesting a twenty-five (25) foot setback from the <br />public road right-of-way: Lots 7-16 and 19-22, Block 3, and Lots 14-16, Block 1, Brookfield <br />Addition; and Lots 19-50, Block 3, as shown on the approved preliminary plat of Brookfield, <br />prepared by Passe Engineering and dated August 26,2005. <br /> <br />4. That the Applicant has stated that the reduced setback is necessary for the following reasons: <br />a) maintain compliance with standard public street right-of-way requirements; b) <br />accommodate stormwater needs within the plat; c) provide usable rear yard space for the lots <br />around the stormwater pond; d) for the 3 lots adjacent to Trott Brook, provide additional <br />space between the proposed homes and the trail as well as preserve additional trees on the <br />site. <br />
