<br />5. That the Subject Property received preliminary plat approval as Brookfield Addition on <br />September 13, 2005 and consists of 241 urban single-family residential lots served by <br />municipal sewer and water. <br /> <br />6. That Brookfield I st Addition received final plat approval on April 25, 2006. <br /> <br />7. That the special conditions causing the undue hardship, namely the presence of the Trott <br />Brook corridor and related trails, and location of the stormater ponding area, do/do not result <br />from the actions of the Applicant. <br /> <br />8. That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />9. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br />Zoning Chapter or other property in the R -I Residential District. <br /> <br />10. That if granted, the variance will not violate the intent and purpose of the City's <br />Comprehensive Plan. <br /> <br />II. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property, substantially increase the congestion of public streets, or increase the danger of fire, <br />or endanger the public safety, or substantially impair property values within the <br />neighborhood. <br /> <br />12. That the variance requested is the minimum variance necessary to accomplish the intended <br />purpose of the Applicant. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Trites Rolle, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Acting Chairpeson Van Scoy <br />Board Member Trites Rolle <br />Board Member Brauer <br />Board Member Hunt <br />Board Member Levine <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />Resolution #06-12-369 <br />Page 2 of3 <br />
