1 i. A proper enclosure exists for the dangerous dog and a posting on the premises with a clearly <br />2 visible warning sign that there is a dangerous dog on the property, including a warning <br />3 symbol to inform children; <br />4 ii. A surety bond issued by a surety company authorized to conduct business in this state in a <br />5 form acceptable to the animal control authority in the sum of at least the minimum allowed <br />6 by Minnesota Statute, payable to any person injured by the dangerous dog, or a policy of <br />7 public liability insurance issued by an insurance company authorized to conduct business in <br />8 this state in the amount of at least the minimum allowed by Minnesota Statute, insuring the <br />9 owner for any personal injuries inflicted by the dangerous dog; <br />10 iii. The owner has paid an annual fee as established by an annual fee schedule and regulated <br />11 per Minn. Stat. § 347 to obtain a certificate of registration for a dangerous dog under this <br />12 section; and <br />13 iv. The owner has had microchip identification implanted in the dangerous dog with the name <br />14 of the microchip manufacturer and identification number of the microchip provided to the <br />15 animal control authority. If the microchip is not implanted by the owner, it may be <br />16 implanted by the animal control authority. In either case, all costs related to purchase and <br />17 implantation of the microchip must be borne by the dog's owner. <br />18 c. Warning symbol. If an animal control authority issues a certificate of registration to the owner of a <br />19 dangerous dog pursuant to this chapter, the animal control authority must provide, for posting on the <br />20 owner's property, a copy of a warning symbol to inform children that there is a dangerous dog on the <br />21 property. The warning symbol must be the uniform symbol provided by the commissioner of public <br />22 safety. The commissioner shall provide the number of copies of the warning symbol requested by the <br />23 animal control authority and shall charge the animal control authority the actual cost of the warning <br />24 symbols received. The animal control authority may charge the registrant a reasonable fee to cover <br />25 its administrative costs and the cost of the warning symbol. <br />26 d. Fee. The animal control authority may charge the owner an annual fee as established by an annual <br />27 fee schedule to obtain a certificate of registration for a dangerous dog under this section. <br />28 e. Dangerous dog designation review. In accordance with Minn. Stat. § 347, beginning six months after a <br />29 dog is declared a dangerous dog; an owner may request annually that the animal control authority <br />30 review the designation. The owner must provide evidence that the dog's behavior has changed due <br />31 to the dog's age, neutering, environment, completion of obedience training that includes <br />32 modification of aggressive behavior, or other factors. If the animal control authority finds sufficient <br />33 evidence that the dog's behavior has changed, the authority may rescind the dangerous dog <br />34 designation. <br />35 f. Law enforcement; exemption. The provisions of this section do not apply to dangerous dogs used by <br />36 law enforcement, fire suppression, or emergency medical officials for public safety duties. <br />37 g. Exemption. Dogs may not be declared dangerous if the threat, injury, or damage was sustained by a <br />38 person: <br />39 i. Who was committing, at the time, a willful trespass or other tort upon the premises <br />40 occupied by the owner of the dog; <br />41 ii. Who was tormenting, abusing, or assaulting the dog or who can be shown to have <br />42 repeatedly, in the past, tormented, abused, or assaulted the dog; or, <br />43 iii. Who was committing or attempting to commit a crime. <br />44 h. Tag. A dangerous dog registered under this section must have a standardized, easily identifiable tag <br />45 identifying the dog as dangerous and containing the uniform dangerous dog symbol, affixed to the <br />46 doe's collar at all times. <br />Page 11 of 16 <br />
